Audit of Bradford City MDC

FREEDOM OF INFORMATION ACT 2000
On 8th March 2011 Rachel Lindley reached a decision that the City of Bradford Metropolitan District Council acted neither unlawfully nor unreasonably with respect to its agreements with the developers of the Broadway site.
I require a full and unredacted copy of all material considered in reaching this decision and all relevant correspondence.

Dear Mr Killip, thank you for your request.
Unfortunately the Commission doesn't hold these records and so we cannot provide them. This is because the information gathered during the audit will be held by the auditor, who is not covered by the Freedom of Information Act.
When carrying their statutory functions, appointed auditors, including those who work for the Commission's Audit Practice are independent of the Commission. They hold their own records that we do not have access to, and work in a quasi-judicial way.
I would recommend asking the council for the information, as they may hold a copy, or you could approach the auditor direct, and ask if they would be prepared to let you have a copy. This though would be at their discretion, and not under the Freedom of Information Act.
I'm sorry that I couldn't help on this occasion.
