Dear Avon and Wiltshire Mental Health Partnership NHS Trust,

You are aware I have been waiting for you to provide responses to TWO FOIA requests for audio recordings submitted via the whatdotheyknow website , the first on the 02 July 2016 ( RFI 627 )
and the second on 27 July 2016 ( RFI 661 ) , both of which are substantially overdue and clearly you are failing to comply with my Rights in Legislation .

I have offered you an alternative method for you to provide the information requested , but you have ignored me.
I am also upset that you fail to keep me updated, and have stated a reason for the delay that does not appear to be valid or true ?

Having spoken with the ICO again, and taken advice from an IT expert ( who sees no valid reason for you failing to comply with my original requests well within the timescales laid down by the FOIA ), I have been told if I were to request the information to be provided on memory stick , it would take only about 5 minutes per meeting to download from your digital memory card on to a memory stick.

Hence, to assist you with your ' claimed difficulty ' , I wish to submit this request, and ask you to ,please supply the information as soon as possible due to the substantial delays you have already subjected me to.

Please supply me with audio recordings of your Board of Management Meetings ( part one - not confidential and open to the public ) which you have stated you do hold for the following dates :
November 25 2015
January 27 2016
February 24 2016
March 30 2016
April 27 2016
May 25 2016
June 29 2016
July 27 2016

on a memory stick please - I am told total time to produce all is about an hour .

Hence I give me consent for you to include all contributions made by me at these meetings within your FOIA responses on memory stick as requested please.

If anything prevents you from providing me with my own data and input and questions raised at these meetings as part of the FOIA process I have asked for, please treat this request also as a Subject Access Request under the Data Protection Act and post to me all of the data and information of mine that has been inputted into each public meeting of your Board of Management up to and including your AGM and Board of Management Meeting held today, 28 September 2016.

17 working days after making this request, I have today received your response,
which reads :

"Further to your request for information to the trust of 9 September 2016 we can now respond.
We have dealt with your request in accordance with your 'right to know' under section 1 (1) of the Freedom of Information Act 2000 (FOIA) , which entitles you to be provided with any information 'held' by a public authority.
Under the FOIA, the trust is not obligated to create information to respond to a request, only provide information held, unless an appropriate exemption applies "

You then list the dates of the meetings requested , and further state

" on a memory stick please -
Under the Freedom of Information Act (L)egislation, the trust is only required to provide the information that you have requested, in the format that you have requested if it is reasonably practicable, including the cost of doing so.

*** It is not reasonably practicable for the trust to provide this information on a memory stick as this is not a format of recording information that the trust uses and would have to purchase memory sticks to fulfill your request, therefore your request is refused "

Please offer me assistance with this request:

1. I wish to know why it took you 17 working days to refuse my request ?
What was the process you went through that delayed my request for so long ?
2. Please give me a clear understanding of all your reasons why you quote paragraphs 2 & 3 in your response, as I do not understand your need for making these statements or how they relate to my request?
3. I refer you to your paragraph starting ' Under the Freedom of Information Act (L)egislation.....'
please explain fully and clearly your reason for making the statements contained within your response and how it relates to my request ?
4.I refer you to your paragraph starting ' It is not reasonably practicable to provide this information on a memory stick....' and you continue to give a number of apparently invalid reasons for not doing so ?
a. I wish to know the alternative formats you can offer me to supply this information, and why alternative methods were not offered within your response.
b. In light of your recently supplying me under FOIA audio recordings of board meetings on CD ,why you have failed to offer me the same option or alternative options now ?
c. Please explain clearly and honestly why it is not ' reasonably practicable 'for the trust to provide this information on a memory stick, other NHS organisations regularly do and have done so ?
d.You state ' as this is not a format of recording information that the trust uses ' , although several of your staff have previously told me and offered me information on memory sticks and do use memory sticks ?

At your AGM last week, staff were issuing memory sticks containing all of the AGM papers to people including the public attending the meeting ?

They had a pile of 30 or so memory sticks printed with AWP and NHS on the protective cover - so clearly your Board and attendees, carers and public , including NHS Improvement used memory sticks produced by yourselves to view your AGM papers ?

You state ' therefore your requested is refused ' . Although this doesn't make proper sense , and you may wish to also correct this error of your ways, I believe in your trusts attempt to continue covering up the real truth about your trust, you have wrongly refused this request and in doing so have AGAIN caused me damage and distress by refusing me my FOIA Rights .

Why are you not open, transparent and truthful , as lies spin and cover up are known to damage service users and patients health ?

Please provide an early and full clear response to all matters raised, and provide the information I have asked for that I wish to use .

I ask for further assistance in understanding your decision please :

2a. Please confirm again the information is ' held ' by you as the public authority,
and how I can obtain it following your refusal of this request ?
2b. Please provide assistance by advising me where you state " ... the trust is only required to provide the information that you have requested, in the format you have requested if it is reasonably practicable, including the cost of doing so. " , which is the most reasonably practicable way for you to provide me with all this information, how the digital audio recorded information is currently recorded and stored, and the estimated cost for providing a total of about 27-30 hours of digitally recorded information on to a memory stick please ?
I am told by my computer shop staff, that any recording that is digitally recorded say on memory card or stick, can be transferred to another memory stick at a maximum time rate of 5 minutes per hour, or 2 minutes per hour on a powerful computer such as those used in the NHS Hospitals such as yours.
2c. In your response you state " It is not reasonably practicable for the trust to provide this information on a memory stick " please explain all your reasons why this is so ?
2d. In your response you state " this is not a format of recording information that the trust uses " please make me aware of ALL the formats you use when digitally recording information and audio recordings, and if true confirm that no staff ever use memory sticks to digitally record any data at AWP ?
2e . In your response you state " and would have to purchase memory sticks to fulfill your request "please confirm how many 32GB memory stickS costing about £6 each that you would require to fulfill my request ,
and that currently not ONE memory stick is available at your corporate HQ to download this information for me ?
2f . Have you taken appropriate advice from the ICO , or your own in house Legal Professionals to confirm the reasons you have given for refusing my request on the grounds you have stated ?

Please be clear I am seeking assistance and clarification with this request , so as to obtain a true picture .

I would like to thank the many twitter users who commented about the negative treatment I am receiving from this trust as a MH patient . This trust is a disgrace and has been for many years, in my humble opinion based on personal experience with them.

Whilst reading your responses to a legitimate FOI request, I notice that you attach the following misleading comments at the bottom of all your correspondence.

Your organisation wrote;
"You matter We care"

Well, after the reading the way that you have messed about Mr King on here - its very clear that your NHS Trust does not seem to "care". Its very apparent by the hassle and time that Mr King spent on this and other FOI requests that former service users really do NOT "matter"?

One has to ponder HOW any member of the public can maintain ..... good mental hygiene when an organisation responsible for providing Mental Health support is openly evasive and unhelpful on a public forum such as this one?

Maybe review whether your tags do adhere to the principles of The Data Protection Act? I propose this because as demonstrated by the manner in which you respond to FOI requests on here - you seem to be factually incorrect and misleading the public that you lot "care"?

Very well put Fiona Watts - and thank you for your time and trouble in stating these facts.

Having been a patient of this trust over a long period since 2011, I really do think they should come with a TOXIC NHS HEALTH WARNING , and that being a patient or becoming involved in any way with them could seriously damage your health or worse .

For those who are interested in the truth about this Trust,
a comprehensive read of my requests and their responses reveals the most serious concerns ive found about this trust.

No doubt more will come to light ...

Dear ??

I note the timescale for you to provide this information has passed , and I regret to say I feel your trust is sinking to an all time low in the way you are abusing your position of power of me , a seriously ill mental health patient who remains unsupported and untreated is elderly and also physically disabled.

I note adverse comments about your trust have been posted here and on twitter regarding your awful handling of this request , and you have not bothered to respond to my further emails to you here regarding this request.

I am totally confused by your response letter and have sought clarification, but am still waiting ?

Is it necessary for an FOIA requestor to provide you with memory sticks when making a request, if requesting the response to be on a memory stick
if so please direct me to the ICO guidance and your own policy/procedure that covers this area ?

I note other well run NHS trusts readily supply data on memory sticks to FOIA applicants without any question or delay ,abuse or controlling bullying of the applicant ? They provide a CARING service, which is amply demonstrated as missing here at AWP.

I understood there was a £450 maximum limit to provide responses to each request made, is that correct ?

My local computer shop states that 300 - 500 hours of just audio recording will fit on to a memory stick
( Philips 32 GB ) and that costs just five pounds fifty pence. Would that be suitable for the response I am due ?

Will you comply with my request if I deliver one of these memory sticks to your Jenner House Headquarters where you are based if you REALLY do not have just one spare memory stick available to comply with my request ?

Where you have stated you do not use memory sticks, I would be interested to know what you intent to do with the 20-25 metal clad swing cover and engraved " www .awp.nhs.uk " on one side and " Avon and Wiltshire NHS Mental Health Partnership NHS Trust " on the reverse side , that were left over after your AGM last week ?

Maybe an unnecessary expense buying these top quality, metal clad and engraved memory sticks when you claim you do not use them ?

You will be needing to borrow millions in additional funding from the NHS at this rate - oh you just did !

Mr Anthony Gallagher , your previous trust chair was always stating ' we must be a more open and transparent trust ' at your board meetings, and Susan Thompson your current chair actively encourages me to use the FOIA route if I need information, your own board minutes confirm what I am saying .

I really would have expected a supposedly CARING NHS Organisation would have dealt with these matters FAR better than you have , and that maybe further changes in the senior management of your trust and the IG team would assist the changes identified as being needed in the 2012 damning reports about you carried out for NHS England , as little has changed and some important areas got far worse.

I am really suffering due to your abusive actions towards me here.

Please stop subjecting me to all this abuse, neglect and substandard service , it further damages my delicate mental and physical health , and I am likely to need increased levels of NHS treatment as a result - NOT from AWP .

I ask you to respond here fully to each of the matters I have found it necessary to raise in my emails to you here dated 03 10 16 and 07 10 16.

Thank you for your eventual response , which exceeded the Legislatory timescales stated within the FOIA Legislation which is 20 working days, it took you 31 working days to supply the information.
A number of people are disgusted at your handling of this request, as is demonstrated within your written responses to me.
Such an old organisation that appears not to learn, and still getting it wrong !
