Attendance at House of Lords event
Dear General Medical Council,
On 19 February 2024, the Department of Health and Social Care coordinated a briefing session for Peers (members of the House of Lords) on the Anaesthesia Associates and Physician Associates Order 2024.
Documents provided by the DHSC, show GMC chief executive Charlie Massey was scheduled to attend this event.
I am requesting the following information:
1) Please provide all e-mail correspondence between DHSC and GMC regarding the briefing event described above.
2) Did Charlie Massey attend the briefing event on 19th February 2024?
2a) If yes, please provide copies of any presentations, reports or other documents used by Mr Massey in the briefing session along with any post-event reports or writeups.

Dear Michael Bridger
I write further to previous correspondence with a response under the
Freedom of Information Act 2000 (FOIA).
Firstly, you asked for all e-mail correspondence between the DHSC and GMC
regarding a briefing session for Peers on the Anaesthesia Associates and
Physician Associates Order 2024 on 19^th February 2024.
Please see the attached bundle. You’ll see that some information in the
attached bundle has been redacted (blanked out).
Some of the redacted information cannot be provided because it would
breach data protection legislation to give this to you. I’ve given details
of the exemptions under the FOIA which applies below.
The exemptions
Section 40(2), by virtue of section 40(3A)(a) - This exemption applies
where the information is the personal data of a third party and where
releasing the information would breach any of the principles relating to
the processing of personal data listed at Article 5 of the General Data
Protection Regulation (GDPR). In this instance disclosure would breach the
first principle, which requires the processing of information to be
lawful, fair and transparent. I do not believe that any of the legal bases
for processing listed at Article 6 of the GDPR are met and therefore
giving you the information would be unlawful.
There is also some redacted information that cannot be disclosed as this
information was provided to us in the expectation of confidence. I’ve
given details of the exemption that applies under the FOIA below.
Section 41(1) - This exemption applies where information has been received
by us as a public authority, and disclosure of the information to the
public would constitute an actionable breach of confidence.
Your right to appeal
If you would like to appeal either of the above decisions, please set out
your reasons in writing to [1][GMC request email]. Please note that we will
only consider appeals received within 40 working days of our response. You
can also appeal to the Information Commissioner, the regulator of the FOIA
and DPA. We can provide more information about this if you need it.
You also asked if Charlie Massey attended the briefing event on 19th
February 2024. I can confirm that Mr Massey did not attend the event but
other GMC colleagues did.
Finally, you asked that if Mr Massey did attend the event, that we provide
you with copies of any documents used by him in the briefing session along
with any post-event reports or writeups. As Mr Massey did not attend the
event, we are unable to provide you with any such documents. However, we
could consider a request for the documents used by other colleagues should
you wish to submit one.
