Hi Sean,
The DWP has considerable form for abusing S.10(3) to delay issuing a response for many months. My suggestion would be complain to the ICO as soon as 40 working days from the date of your request has past or the DWP issues yet another S.10(3) notification.

I've had requests where the DWP has done this month after month until the ICO stepped in & told it to issue its full response.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department for Work and Pensions's handling of my FOI request 'ATOS and Capita Posts'.

My request has been rejected on the grounds of Section 31 (1) (a). This is clearly inappropriate as the exemption does not cover the contents of the request given.

Reference is made to a BBC story on fraud in this request only to identify the internal message board referenced within it. My request (plainly) is not specifically aimed at the topic covered within that story, but rather at other communications on the board.

Should any of the posts covered by my request fall into the thread referenced in the BBC story, which the department does not which to be released, I am content for those elements of my request to be withheld or redacted.

Plainly the majority of posts matching the strings ATOS or Capita will be discussions of the performance of or interactions with those companies as experienced by DWP staff, not of fraud or criminal activity. As such the exemption is not valid, and has been made without a proper reading of the full request but merely by glancing at the reference made for identification purposes.
