Dear Bromsgrove District Council,

According to the land registry you are the owners and responsible for the upkeep of the area of Aston Road unadopted by Worcester CC.
Please provide;

1) The last time the condition of this road within your remit of responsibility was inspected by BDC.
2) The last time the lights running alongside the pavement were inspected / maintained.
3) The last time the conifers running alongside the pavement were cut back and the planned frequency for this to be done.
4) If records exists, the number times BDC environmental services have had to clear suspected (not confirmed) human remains (both liquid and solid)
along this road year to date 2020 then every year 1st Jan - 31st December for the years 2019, 2018 and 2017.

Dear Mr Cooper,

 

Thank you for your recent Information request. I can now offer you the
following information:

 

According to the land registry you are the owners and responsible for the
upkeep of the area of Aston Road unadopted by Worcester CC.

Please provide;

 

1) The last time the condition of this road within your remit of
responsibility was inspected by BDC. An inspection has not been held
during the last 5 years, and for the period before that, the information
is not held.

 

2) The last time the lights running alongside the pavement were inspected
/ maintained. The ownership of the lights is currently in dispute between
Bromsgrove District Council and Worcestershire County Council.

3) The last time the conifers running alongside the pavement were cut back
and the planned frequency for this to be done. The conifers are the
responsibility of the adjacent landowner, and are behind their boundary
fence to the highway, so Bromsgrove District Council has no responsibility
for these.

4) If records exists, the number times BDC environmental services have had
to clear suspected (not confirmed) human remains (both liquid and solid)
along this road year to date 2020 then every year 1st Jan - 31st December
for the years 2019, 2018 and 2017. This information is not held. We do not
keep records of specific types of waste removed as part of our routine
litter picking

Dear foi BDC,

Thank you for your reply. I do however challenge your response to 3. Whilst some of the conifers are planted on the Severn Trent side of the boundary fence, the majority are planted on the road side of this fence making them your responsibility to maintain. These conifers are causing an obstruction to the lights and the path.
You would also have a duty of care to ensure the trees on the Severn Trent side are being maintained to a suitable standard.
Please under FOI inform me of the dates of any communication sent to Severn Trent asking them to cut back the trees on their side of the boundary fence and with a date of when the others on your side of the boundary fence will be cut back.
Also, when do you expect to have the outcome of your dispute with WCC regarding the ownership of the street lights ? With the land registry showing BDC as the landowners then these lights are on your land. Some residents on Breme Park are too intimidated to walk down here in the hours of darkness so these lights need to be fixed before the end of British Summer Time.
Lastly, with no records of any inspection of the road surface being carried out and it being in such a poor state with some potholes falling within the category 2 and on a major road would require an immediate temp fix and made good within 28 days, by what date will this road surface be addressed ?
