Thank you for your e-mail dated the 20 September 2011, in which you have
requested copies of all correspondence between the Charity Commission and
AVOW since 1 November 2010.

 

I have considered your request under the Freedom of Information Act 2000
and we are responding under the terms of that legislation.

 

I can confirm that we hold copies of the following correspondence:

 

1. From the Charity Commission sent to all the trustees of AVOW dated 30
August 2011

2. From AVOW to the Charity Commission dated 1 September 2011

3. From the Charity Commission to AVOW dated 1 September 2011

4. From AVOW to the Charity Commission dated 20 September 2011

 

I am able to disclose copies of correspondence listed as items 1. 2. and
3.  These are enclosed with this e-mail.  

 

I am not able to disclose copies of correspondence from AVOW to the
Charity Commission dated 20 September 2011 ( item 4. ) because the
information contained in the correspondence you requested is exempt under
section 31 of the FOI Act, as it is information which if disclosed, would
be likely to prejudice the carrying out of the Commission's functions as
set out in section 31 (2) (c).

 

Those functions are:  “the purpose of ascertaining whether circumstances
which would justify regulatory action in pursuance of any enactment exist
or may arise".

 

In the course of considering concerns raised about charities, the
Commission relies on trustees and the charity engaging in open and frank
correspondence about the issues.  Were we to release this information, it
would discourage the charity and its trustees from corresponding with us
in the same open and frank way, reducing the amount of information that we
would have to work from. This would prejudice our ability to carry out our
functions as set out in section 31 of the FOI Act.

 

If you are unhappy with our response to your FOI request, have a complaint
or wish to request a review of our FOI decision, you should write to:

which will assist us when we review our response.

If you request a Decision Review you will be notified of our final

the original decision. You will be deemed to have received written
notification on the day after the letter enclosing the decision was sent
or the same day if the decision was sent by email.

If after this you remain unhappy with the decision, you may apply directly
to the Information Commissioner (ICO) for a decision.  Generally, the ICO
cannot make a decision unless you have exhausted our complaints
procedure.  The Information Commissioner can be contacted at: The

Item 4 (from AVOW to Charity Commission) has been refused, yet both AVOW and the Charity Commission have referred both to this document and a further document (Charity Commission to AVOW) in public.

For instance, in the Wrexham Leader on 5 October 2011, an article entitled 'Insurers pay out award made against AVOW' states:

"Mr Rosenberg [chair of trustees] also said AVOW had been in contact with the Welsh Charity Commission. He has written to the commission in response to questions it has raised following the tribunal.
"'AVOW has commissioned a review of the tribunal's findings and when that is complete the trustee board will consider its recommendations and make whatever additional changes to our human relation policies necessary and take any further steps we feel to be required' he wrote.
"A letter from Harry Iles of the charity commission to Mr Rosenberg reads: 'Thank you for your letter. I can confirm I regard this as a full and proper response to my lettter in which I asked the trustees to set out the actions they intend to take as a result of the judgment.
"It is evident that a great deal of thought and discussion has gone into the detail of your response.
"The decision to commission a review into the circumstances relating to the case and the findings of the tribunal in order to make recommendations for action is an essential and constructive response by the trustee body.
"This process, together with the actions you have listed, including obtaining external advice, accreditation and training, should enable them to address the criticisms in the judgment and strengthen the governance of AVOW."

Given that the correspondence has already been referred to in detail in public, said correspondence should be disclosed by the Commission.

Indeed, Chair of Trustees Mervyn Rosenberg circulated the reply from the Charity Commissioners to the media as a complete document, reproduced in full below;

I can confirm that I regard this as a full and proper response to my letter in which I asked the trustees to set out the actions they intend to take as a result of the judgement.
 
It is evident that a great deal of thought and discussion has gone into the detail of your response.  The decision to commission a review into the circumstances relating to the case and the findings of the Tribunal in order to make recommendations for action is an essential and constructive response by the trustee body.  
 
This process, together with the actions you have listed, including obtaining external advice, accreditation and training, should enable them to address the criticisms in the judgement and strengthen the governance of AVOW.
 
Please could you circulate this e-mail to AVOW's trustees on my behalf.
