I understand that an association is being formed, named the "Association of Continuous Cruisers" (the "Association"). I understand that a constitution has been drafted and that the inaugural meeting of the Association is to be held in the next few days.

Please provide:

1. Evidence of the awareness by CRT of the preparatory steps of the creation of the Association.

2. Evidence of direct or indirect involvement in the creation of the Association or provision of input into the creation of the Association.

3. Evidence of request from the founders of the Association to CRT for the provision of CRT staff time into Item 2.

4. Evidence of direct or indirect provision of CRT staff time into Item 2.

5. If the response to either Item (3) or Item (4) is not "none", the name of the senior manager involved.

6. The value of any expenses incurred by CRT in relation to Item (2).

7. The value of any resources provided by CRT to the Association or its founders.

For the avoidance of doubt this is a requisition under the Freedom of Information Act.

To assist the the person making the request, the following was posted yesterday on facebook by 'John Evans' (similar posts have been made on other pages with the organisation sometimes being called called Association of Constant Cruisers) -

A new association is being formed. It will be known as the Association of Continuous Cruisers.

Below is where we are with it.

Here's where we are with ACC.

We have a web page in development.
We have founder members.
We are ready to open a bank account.
We have a secretary and treasurer to help us get acc off the ground.
We have the basics for the constitution.
We have the application form drawn up.

The web page is being developed for us by skippy. (He was one of the attendees at the cc-crt meeting last november)

Our founder members have been with us since the start of this process last january. They have given input, time and advice on much of what john and myself were doing.

They are:
Lesley jordan
Owen davies.
Matty (non facebook)
Louise yeoman (interim secretary)
Lesley lyndon (non facebook, interim treasurer)
Stan Thomas (non facebook)
Ronni Payne
There are 2 others who at the moment do not wish to be named on facebook.
The next step is to arrange a meeting of all the founder members before the birmingham floating market. We are in the process of doing this.
If all founder members are happy with the interim set up when presented to them, we will be looking to launch the ACC at the market.The constitution will be an ongoing document obviously. As membership grows, we will of course expect better input

Canal and river trust have given support to the association, and have agreed to recognise it's representation of ccers

The NBTA aims to support the work of other boating and travellers' organisations wherever this is consistent with the aims of the NBTA. I made the request in response to a number of queries from people who had expressed concern about the proposed association's relationship with CRT, based on what they had seen on Facebook.

Information Request, Canal & River Trust

Dear Mr Brown,

We have considered your request and I can confirm that the information you have requested relates to the general administration and organisational management and the general conduct of the business of the Canal & River Trust rather than its statutory functions and, therefore, your requests fall outside the Freedom of Information Act.

The Canal & River Trust is a charitable company limited by guarantee that is not owned or controlled by any public body. Accordingly it is not a “publicly owned company” within the meaning of s.6 Freedom of Information Act 2000. Furthermore, Canal & River Trust is not a body listed in Schedule 1 of the 2000 Act on an unlimited basis (unlike public authorities) and is therefore not subject to the Freedom of Information Act for the generality of its activities. That includes its general administration and organisational management and the general conduct of its business. Therefore, in that context Canal & River Trust is in the same position as other charities independent from government.

The Canal & River Trust is however also a statutory undertaker and for a limited range of its activities it derives its powers from statutory functions transferred to it from the British Waterways Board (“BW”) by the British Waterways Board (Transfer of Functions) Order 2012 (“the Order”). The Order amended the Freedom of Information Act 2000 to provide that the 2000 Act applies only to information held by Canal & River Trust relating to the functions (i.e. statutory powers and duties) transferred from BW to Canal & River Trust by virtue of the Order. Only certain statutory functions of BW were transferred to Canal & River Trust - essentially those giving it authority and obligations to operate and maintain the waterways. The generality of the other activities of Canal & River Trust are exercised by it as a company limited by guarantee outside the public sector and are not dependent on statutory powers. Accordingly, the Canal & River Trust is not a public body subject to the requirements of the Freedom of Information Act in respect of its activities that are not exercisable by virtue of specific statutory functions transferred to it.

Nevertheless, voluntarily I can tell you that the week before last we were we informed that a new association, the Association of Continuous Cruisers (ACC), was to be launched. John Dodwell (Trustee), Vince Moran (Operations Director) and several other senior staff have been at meetings periodically over the past 12 months at which some of the founders of the ACC were present. All of these meetings which were for all types of boater, not only continuous cruisers, were organised and paid for by the boaters concerned and representatives of the Trust attended by invitation. Their purpose was to improve the Trust’s understanding of boater perspectives and boaters’ understanding of the Trust. None of the discussions were about the formation of a new association. Furthermore, no expenses have been incurred to provide support or resources to the ACC.
