1. a. Please provide a typical Tenancy Agreement used by the council.
b. Please provide your policy, decision making guides, procedures, forms, instructions related to the tenancy assignment procedure.
2. For each of the last 4 years please provide the number of assignment requests received broken down into categories based on the proposed recipient and on whether the original tenant proposes to stay in the property after the assignment:
a. to spouse/partner, original tenant staying
b. to spouse/partner, original tenant leaving
c. to other relatives, original tenant staying
d. to other relatives, original tenant leaving
3. How many requests have been approved by the council broken down by year and categories as in 2 above.
4. How many requests have been rejected by the council broken down by year and categories as in 2 above.
5. How many days it took on average from receiving the request to applicants being notified of the decision broken down by year and category as in 2 above.

Our housing management system does not record any information on
assignment rejections. Following a request for officers to check their
records there has been an average of 2 rejections per year since 2018.

Our housing management system does not record any information on
length of time between request and notification of a decision.

 5. For the requests refused can you provide brief grounds for refusal

grounds of refusal. As our housing management system does not record
some of the information requested and the cost limit would be exceeded
in answering your request, we have narrowed it down and provided
information held within the limits.

I am writing to request an internal review of Cambridge City Council's handling of my FOI request 'Assignment Statistics'.

In 1b of my request I requested " Please provide your policy, decision making guides, procedures, forms,

In your response you provided a link to your Assignment policy. You did not provide the rest of the information requested in 1b, namely: "decision making guides, procedures, forms,
instructions related to the tenancy assignment procedure.". Therefore please provide copies of forms used in the process (such as by tenants making requests or by staff logging and processing assignment requests) as well as copies of procedures / instructions / guidance / flowcharts etc. that re used by council officers concerned with processing assignment requests.

In response to my requests 2-6 you provided some helpful information, namely total number of requests received in each of the last 4 years. You have also stated that on average there has been 2 rejection per year without, unfortunately, actually providing the breakdown per year.

You have then refused to provide any more information citing cost limits which you have correctly identified as 18 hours. You have suggested that the request can be further considered if a payment is made.

However, given how little information has been provided I am extremely surprised by your claim that you have already exhausted the quite generous cost/time limit.

Part 1 of my request could not have taken more than 30 minutes based on how little information you have provided. However, to provide all the information required by 1b (not what you have provided so far), I am prepared to accept, could take up to 3 hours. Obviously, the relevant officers of the council must know what procedures/forms/guidance they use and should e reasonably quick in supplying those.

This leaves 15 hours for parts 2-6 of my request. I accept you do not log in tenancy assignment requests in a way that captures all the information I have requested in a readily searchable computer system and hence you can not provide information requested by just pressing a few keys on a keyboard. However, you had just 10 assignment requests in 2021 and just 4 in 2020. Even if you had to individually open up each of the assignment request files to capture information requested in parts 2-6, it is very hard to think it could take more than 1 hour per assignment request (15-30 minutes being more likely time). Therefore, I am not prepared to readily accept that you could not satisfy Part 1 of the request AND Parts 2-6 in respect of 2021 (and probably 2020) within the allowed time/cost limit.

 Apologies for the delay, please find below part 2 of our response as
stated in our email from the 1/08/2022.

We have gone through our records to check assignments on housing officers
patches for the last 4 years to answer these parts of the FOI below. There
are only two records of accepted assignments in the past 4 years. This is
only accepted assignments as we have no way of capturing refused
assignments without checking every single one of our tenancies, as stated
in your response on the 1/08/2022.

However, we have noticed when we assign a tenancy, we keep the original
tenancy on our system, so there could be tenancies that have been assigned
in the past 4-years but because the original tenancy started over 4-years
ago they are not captured in our data for the last 4 years. E.g. if
someone started their tenancy in 2002 and then assigned it in 2020, it
wouldn't be included in those stats.

Please find attached policies for part 1 of your request.

2. For each of the last 4 years please provide the number of accepted
assignments broken down into categories based on the proposed recipient
and on whether the original tenant proposes to stay in the property after
the assignment:

a. to spouse/partner, original tenant staying = 1

b. to spouse/partner, original tenant leaving = 0

c. to other relatives, original tenant staying = 0

d. to other relatives, original tenant leaving = 1

So in all approved assignment requests over the past 4-years, the original
tenant has left.

3. How many requests have been approved by the council broken down by year
and categories as in 2 above.

Both assignments were in 2020/21.

5. How many days it took on average from receiving the request to
applicants being notified of the decision broken down by year and category
as in 2 above.

The average of these two assignments took 41 days (incl weekends)

Although there are only 2 our officers had to go through each of their
records, hence the reason for delay and original response. 

We hope we have provided everything we can for you now and our explanation
for reason of not providing the information previously is sufficient.
