Dear Cumbria Fire and Rescue Service,

I make this request under the Environmental Information Regulations 2004.

My request concerns the assessments made to inform Cumbria Fire and Rescue Service’s consultation response for planning application 1/23/9005 (Cumbria Fire and Rescue Service reference FSL 16/C2048629/508187/SGS).

Please provide all assessments held by Cumbria Fire and Rescue Service regarding planning application 1/23/9005 (including minutes of meetings and assessments included in emails) in relation to:

1. The capacity of the proposed drainage to store the quantity of water that may be necessary to extinguish a major fire.
2. The availability of sufficient water to extinguish a major fire.
3. The risk that a fire may spread either to or from the wider Northern West Recycling site.
4. The risk of explosion.
5. The adequacy of access for emergency vehicles, including any assessment of the risk that access may be blocked due to vehicles queuing to load/unload either to this site or buildings/locations elsewhere at the wider North West Recycling site.
6. The magnitude of risk reduction anticipated by Cumbria Fire and Rescue Service from installation of sprinkler systems at the “premises” when the only “premises” that forms part of the proposal would appear to be a porta cabin office building separate from areas of greater fire risk (which include the gasification process, pipe work to move the gas, engines that combust the gas, potentially gas refinement , electrical transformers and potentially storage/refinement of liquid fuels such as diesel for the Thermal Oxidisers).
7. The risks posed by the applicant’s proprietary process.

The Fire and Rescue service consultation response itself need not be included nor any application documents available on the Council’s planning website under 1/23/9005.

I am writing to request an internal review of Cumbria Fire and Rescue Service's handling of my request 'Assessments regarding planning application 1/23/9005'.

The response from Cumbria Fire and Rescue Service quoted some, but not all, of the original request. The missing sentences included:

• “My request concerns the assessments made to inform Cumbria Fire and Rescue Service’s consultation response for planning application 1/23/9005 (Cumbria Fire and Rescue Service reference FSL 16/C2048629/508187/SGS).”
• “The Fire and Rescue service consultation response itself need not be included nor any application documents available on the Council’s planning website under 1/23/9005.”
• “If no information is held, please state no information is held.”

My request asked for the “assessments held by Cumbria Fire and Rescue Service regarding planning application 1/23/9005 (including minutes of meetings and assessments included in emails) in relation to …” followed by 7 important matters.

Cumbria Fire and Rescue Service’s information request response says:

“Cumbria Fire and Rescue Service (CFRS) responded to the planning consultation in December 2023, as a consultee on the planning process. Our response is publicly available.”

The information request response does not include the assessments that I requested, neither does the response say that “no information is held”. I therefore ask Cumbria Fire and Rescue Service revise its response to provide the information requested. For each of the 7 items, please provide the information, or point me to the sentence in the consultation response that includes the assessment, or respond “no information is held”.
