Dear Wirral Metropolitan Borough Council ('the Council'),

Please provide FULL DETAILS of the ASHTON COURT retirement flats [22], Ashton Drive West Kirby. PRE-PLANNING APPLICATION discussions MEETING, held on 7 March 2016 attended by Mr Neil Williams (Planning Officer) and representatives of the 'STARFISH GROUP' which apparently now owns the TWENTY TWO retirement homes at Ashton Court.

The Starfish Group states, in its Design and Access Statement, submitted as a part of its APP/16/00823 planning application that:

"It was deemed the overall principles of the site were acceptable". (Page 6).

Many local residents do not find the overall principles of the site acceptable!
515 people signed a petition, over the course of the last few weeks objecting to the plan to demolish the 22 retirement flats and replace them with 14 houses.

Wirral Council can advise that there are no recorded notes from this
pre-application meeting.

I am writing to request an internal review of Wirral Metropolitan Borough Council's handling of my FOI request 'ASHTON COURT retirement flats [22], Ashton Drive West Kirby. PRE-PLANNING APP' MEETING.'.

I am not satisfied that a Senior Planning Officer kept no notes of a meeting held with a developer.
Notes should have been kept, especially as the developer referred to the meeting in the Design and Access Statement.
If the Senior Planning Officer kept no notes, was this after a 'heavy' weekend or is it Council policy not to keep notes?

   As the reviewing officer I can confirm that the council holds no
recorded notes from this pre-application meeting.  It is not normal
practice for recorded notes to be taken at a pre-application meeting.

 

You have the right to complain to the Information Commissioner  if you are
dissatisfied with the result of your internal review under Section 17 of

Please note that the Freedom of Information Act 2000, Section 14 allows
for a Public Body to refuse a request for information if that request can
be viewed as vexatious.  The Act gives examples of what can be viewed as
vexatious and this includes:-

 

 “The tone or language of the requester’s correspondence goes beyond the
level of criticism that a public authority or its employees should
reasonably expect to receive.”

“The request makes completely unsubstantiated accusations against the
public authority or specific employees.”

 

I believe that your request falls into the vexatious category and I must
advise that any future requests which fall within the meaning of
vexatious, as defined by the legislation will be refused.
