1) a communication disorder unit or a autistic unit has been found or suggested to be a school within its own right, a separate school, a separate legal entity (to the mainstream school within which its unit is based) or a mini special school (such units known as "separate institution" within this request);
2) a unit (communication unit or autism unit) has been found to be a separate institution and therefore it cannot in law be named in Part 4 of the relevant statement of educational needs.

We refer to your Freedom of Information Request in respect of ASD Units /
Tribunal decisions, the Authority’s response is as follows:

 

In the last 12 months has the LA been involved in any tribunal
hearings/decisions within which:-

2)    a unit (communication unit or autism unit) has been found to be a
separate institution and therefore it cannot in law be named in Part 4 of
the relevant statement of educational needs: The unit was found to be a
separate school and, in the above tribunal, it could not be named in Part
4 of the relevant statement of educational needs.
