I understand that, due to restrictions on who can see warrant information
under the Building (Scotland) Act 1959 in terms of which a demolition
warrant was approved, limited information is available under the
demolition warrant to persons with an appropriate interest. In the
circumstances, I should be obliged if you would confirm your interest in
the property, for example as a former owner or tenant or their legal
representative.

I refer to your email of 16 April 2013 requesting (1) asbestos surveys,
(2) risk assessments for renovation or refurbishment work or demolition
work detailing asbestos materials and (3) building warrants for renovation
or refurbishment work detailing asbestos materials in relation to flats at
6 Lansbury Road, Greenock during the period from 1968 to demolition in
terms of the Freedom of Information (Scotland) Act 2002.

 

Inverclyde Council (“the Council”) has considered your request for
information and takes the view that it should more properly be treated as
a request for information under the Environmental Information (Scotland)
Regulations 2004 (“EIRs”). Information which falls under the ambit of the
EIRs is exempt from the Freedom of Information (Scotland) Act 2002
(“FOISA”), under Section 39(2) – Health, Safety and the Environment.

 

On inspecting our records and the information which we hold it would
appear that the information requested is covered by exceptions contained
within the EIRs and I would advise as follows:-

 

(1) I have been advised that the property at 6 Lansbury Street (not Road)
was demolished in 2002/03, before Inverclyde Council started carrying out
asbestos surveys, as set out in the attached refusal notice.

 

(2) The Council transferred its housing stock to River Clyde Homes (RCH) a
registered Social Landlord in December 2007 and does not have any records
relating to the former Housing Services department, as set out in the
attached refusal notice. I can confirm that all property and tenancy
records were transferred to RCH in December 2007, this would have included
information on demolition of the former council houses in the Gibshill
area of Greenock. I understand that Lansbury Street was redeveloped in two
phases by different developers. However, it is believed that the former
tenement at 6 Lansbury Street was on the south side of the street which
was redeveloped by Persimmon Homes to provide cottage type houses and that
these were subsequently purchased by Cloch Housing Association and are now
let as social rented housing.

(3) The demolition of these properties was covered by a demolition warrant
BC/02/550 approved under the Building (Scotland) Act 1959 on 6 December
2002. In terms of the EIRs, I am unable to provide you with information in
this regard as this is exempt from release in terms of Regulation 10 (5)
(d) which relates to the confidentiality of the proceedings of any public
authority where such confidentiality is provided by law, as set out in the
attached refusal notice.

 

You have previously stated that you are the legal representative of a
former tenant. This statement, however, is not currently sufficient to
show that you have reasonable cause in terms of the Building (Scotland)
Act 1959 to access the information requested. If you wish to access the
file under the Building (Scotland) Act 1959, I should be obliged if you
would forward me a mandate completed by your client authorising you to
make enquiries on his/her behalf and to access all relevant data from
Inverclyde Council in terms of the Data Protection Act 1998 and also
provide me with a personal email or postal address to enable me to forward
the relevant information to you.

 

If you are dissatisfied with the way the Council has dealt with your
request, you are entitled to require the Council to review its decision. 
A copy of the Council’s Review Procedure is attached for your information.
