Dear Health and Safety Executive,

MBR Acres Ltd, Wyton Huntingdon

Can I please have a copy of the Asbestos Inspection Reports from 2017 to date for this site?

Yours faithfully,

Tarnia Wilson

Health and Safety Executive

Thank you for contacting the Health and Safety Executive’s (HSE) Central Disclosure Unit.

Please take this automated email as formal acknowledgement HSE have received your request for information and are processing it. HSE will endeavour to respond to your request within statutory timescales – 20 working days for requests that fall within scope of the Freedom of Information Act or Environmental Information Regulations and one month for requests that fall within scope of the Data Protection Act 2018. If you are seeking an internal review of a previous disclosure decision, HSE will also endeavour to respond to your request within the Information Commissioners recommended timescale for response of 20 working days. HSE request you do not seek an update on the status of your request before the statutory / recommended date for response has expired.

As with many public sector organisations the pandemic has had a major impact on our ability to undertake day-to-day operations which has resulted in HSE not always being in a position to respond to requests within the statutory / recommended deadlines detailed above. HSE ask for your patience at this time and assure you a response will be provided within due course.

Elizabeth Van Duyvenbode, Health and Safety Executive

Dear Elizabeth Van Duyvenbode,

Can you please explain your answer bearing in mind the following:

MBR Acres Ltd have an establishment licence issued by the Home Office to breed dogs for use under the Animals in Scientific Procedures Act 1986.

The establishment has Asbestos and does not appear to be registered anywhere by the HSE. There are clear signs at the establishment, but according to the HSE (who are responsible under regulations) you have no record.

These animals are supposed to be clean for toxicology testing, but if they are in an area contaminated with asbestos, MBR Acres cannot possibly claim on their website these are clear from contaminates and they are not fit for the scientific purpose intended.

Questions:

1) why is there no registration of the Asbestos with the HSE as this should be cleared or monitored?

Yours sincerely,

Tarnia Wilson

Dear Tarnia Wilson,

HEALTH AND SAFETY AT WORK ETC ACT 1974

CONCERN RAISED WITH HSE

Thank you for contacting the Health and Safety Executive (HSE).

We have carefully reviewed the information you provided and concluded that on this occasion, we will not follow-up this matter. The reason is because HSE primarily investigates ongoing unsafe work activity where there has been a significant breach in health and safety law. Asbestos can be found in any house or building built before the year 2000 as it was widely used in a variety of building materials. If there is asbestos present in the building, there is no evidence to demonstrate that this is not being handled appropriately by the dutyholder.

Please note this is a no reply email account and any reply will not be received by HSE.

Yours sincerely,

Lee Millea

Dear Health and Safety Executive,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Health and Safety Executive's handling of my FOI request 'Asbestos Report for MBR Acres Ltd Wyton'.

This is not an acceptable answer to the request for information. There is asbestos on site. The HSE are responsible.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/a...
