Asbestos Management

Dear Whitehaven Academy, Cumbria,

Can you please tell me what steps have been taken to find asbestos and assess the condition of these materials on Whitehaven Academy premises, to comply with the Control of Asbestos regulations 2012 ? Who is your duty holder?

Has any asbestos been found in the school? What assessments have been made of any asbestos found?

Who is responsible for preparing and implementing a plan to manage any risks and providing information on the location and condition of the materials to anyone who is liable to disturb them.

I request answers to the above and would like electronic copies of all information in respect of your asbestos management planning, locations of asbestos found within the school, what is being done to encapsulate or remove any asbestos. Please include documentation regarding any annual re-inspection to monitor the condition of asbestos from a professional perspective.

We write further to your email of 9th September, in which you requested information about asbestos management at the Whitehaven Academy and we respond as follows:

The 'duty holder' is the owner of the premises or the organisation that has responsibility for maintenance or repair. We can confirm that Bright Tribe Trust is the owner of the premises and that the duty rests with its subsidiary company, Bright Tribe (FM) Limited, which is responsible for facilities management.

The steps taken to find asbestos involve the preparation of an asbestos management survey and the maintenance of an asbestos management plan, which is reviewed regularly, for which Bright Tribe (FM) Limited is responsible.

We can confirm that asbestos has been found, the assessment of which forms part of the asbestos management processes referred to above. Surveys are carried out prior to any works taking place in which asbestos-containing material may be disturbed. The asbestos would be encapsulated or removed by licensed contractors.

Finally, you have requested ‘all information’ in respect of:

• asbestos management planning;
• locations of asbestos found within the school;
• what is being done to encapsulate or remove any asbestos; and
• documentation regarding any annual re-inspection to monitor the condition of asbestos from a professional perspective.

We believe you will find that the further information you seek is accessible to you, being contained in the asbestos management survey and plan as referred to above. Those documents are sizable but are available for inspection at Whitehaven Academy upon request.

If you are dissatisfied with the handling of your request, you have the right to ask for an internal review. Internal review requests should be submitted within two months of the date of receipt of the response to your original letter and should be addressed to: The Chief Operating Officer, Bright Tribe Trust, Building 1000.

If you are not content with the outcome of the internal review, you have the right to apply directly to the Information Commissioner for a decision.
