Asbestos in Flintshire schools

Dear Flintshire Council,

Under the Freedom of Information Act 2000, please provide me with the following information:

1. The names of the schools in your county that contain asbestos.
2. The date and outcome of the last independent audit or inspection of each of these schools Asbestos Management Plans.
3. The details of any reported incidents of asbestos exposure in these schools between 2011 and 2016.
4. Details of any improvement or prohibition notice served or guidance issued by the HSE in relation to the management of asbestos in schools in your county in the last 5 years.
5. The number of school employees (existing and retired staff to include teaching staff, school support staff and caretakers, etc) and ex-pupils that have pursued a claim against you for exposure to asbestos within a school in your county.
6. The number of these claims that have been settled.
7. The amount of money that has been paid in settlement of these claims (with and without your authority accepting responsibility).

I understand that under the Act I am entitled to a response within 20 working days of your receipt of this request. Some parts of the request may be easier to answer than others. Should this be the case, I request that you release information as soon as possible.

If my request is denied in whole or in part, I ask that you justify all deletions by reference to specific exemptions of the Act. I will also expect you to release all non-exempt material. I reserve the right to appeal your decision to withhold any information or to charge excessive
fees.

• 70 schools assets have asbestos containing materials (ACMs) identified
within the fabric of the building to which the attached spreadsheet
titles ACMs in FCC Schools 2016 refers

2. The date and outcome of the last independent audit or inspection of
each of these schools Asbestos Management Plans.

• All school assets have been subject to an asbestos survey and an
on-going process of resurveying/re-inspections in compliance with the
Control of Asbestos regulations 2012 and related HSE guidance e.g. HSG
264 - Asbestos: The Survey Guide.
• During these re-inspections the Asbestos Management Plan is reviewed
and updated respectively. All asbestos surveys are carried out by
independent UKAS accredited asbestos survey companies to the current
HSG264 standards

3. The details of any reported incidents of asbestos exposure in these
schools between 2011 and 2016.

• No information held, Nil response

4. Details of any improvement or prohibition notice served or guidance
issued by the HSE in relation to the management of asbestos in schools in
your county in the last 5 years.

• There have been no improvement/prohibition notice served/issued by HSE
in the last five years.

5. The number of school employees (existing and retired staff to include
teaching staff, school support staff and caretakers, etc) and ex-pupils
that have pursued a claim against you for exposure to asbestos within a
school in your county.

• No Asbestos incident in Schools for the dates requested.

6. The number of these claims that have been settled.

COMPLAINTS PROCEDURE

This procedure is exclusively for dealing with complaints in relation to
the operation of the Environmental Information Regulations (EIR) within
Flintshire County Council (Council).

This procedure applies to any person who considers that their request has
not been properly handled or who is otherwise dissatisfied with the
outcome of the consideration of their request made under the EIR

Before making a complaint you are encouraged to contact the officer
dealing with your request in case there has been any misunderstanding or
oversight which can quickly be rectified.

The stages of the complaints procedure:-

Any complaint should be made in writing addressed to the EIR Complaints
Officer, Information Governance, County Hall, Mold,
CH7 6NA or by e-mail to [1][email address] giving full details of your
complaint.  It must be made within 40 working days of the
alleged failure to comply with the EIR.

Your complaint will be referred to a complaints officer to investigate and
carry out an internal review of the original response to
your request.  This person will not have made the original decision on
your request and will be a senior officer of the Council.

The first task of the complaints officer having read your complaint is to
send you a written acknowledgement with a target date for a decision on
it.  If the review has not been completed by the target date, at that time
you will be written to explaining the reasons for this and giving a
revised target date.  The complaint will be dealt with as quickly as it
can be and in any event within 40 working days of when the complaint was
received.

Following a thorough internal review you will receive a written response
to your complaint which will advise you of your right to appeal to the
Information Commissioner if you remain dissatisfied.  The Information
Commissioner’s office is at: Wycliffe House, Water Lane, Wilmslow,
Cheshire SK9 5AF.

The intention of this complaints procedure is to provide an internal
review process that is fair, impartial, clear and simple and carried out
quickly.
