Asbestos at the SBCV site

The request was refused by Calderdale Metropolitan Borough Council.

Dear Calderdale Metropolitan Borough Council,

With regards to planning application 11/00200/FUL: Reports written in 2010 by ARUP regarding the SBCV scheme concluded that Asbestos was found in several areas of the development site. The report said that further testing needed to be conducted to established exactly how wide spread asbestos is in the soil of the development site.
Was this additional testing for asbestos conducted before soil was dug up for use in the infrastructure works?
Has any soil containing asbestos been removed from the development site?
Has a full risk assesment been written with regards to protecting workers from possible contact with asbestos?
Will any further asbestos testing be conducted before the development site is built on?

Dear Mr Marsden

 

Further to your email of 1 May, as stated in my letter to you dated 25
April 2012, we are unable to inform you whether any soil containing
asbestos has been removed from the site until the Validation Report has
been received.

 

I have been told that the report will not be agreed and accepted until it
contains clear information as to where any soil containing asbestos has
gone.

 

Also, as stated in my letter, the report will be published on the website
when it has been agreed, but I have already requested a copy be sent to me
and I will forward it on to you as soon as it is available.  However,
could you please let me know which email address you would like me to send
it to.

Dear Calderdale Metropolitan Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Calderdale Metropolitan Borough Council's handling of my FOI request 'Asbestos at the SBCV site'.

The council stated that a validation report would be available in due course. This was months ago and a report is still not available.

I believe that no such report has been written due to a lack of funding on this development project and that council officers have not told the truth by saying that this report existed.

It is my opinion that the site poses a hazard to the public and should be sealed off to the public as no evidence can be provided by the council to state otherwise.

If I do not obtain this report within two week I shall write a formal complaint both to the CEO of the council and the information commissioner.

In response to your request for an internal review into request titled

Having spoken with the team about the future publication of the validation
report I have been informed that the verification report wasn’t submitted
and Gern8 are not required to submit it until remediation is complete,
therefore in terms of my review of the handling of your request I feel I
must uphold our original decision and inform you that when the report is
finally submitted by Genr8 to us we will make it available for
publication. Until that time we do not hold the requested information.

Dear Tracie Robinson,

In my original response which was sent out in May it was stated
"In this instance the documents requested in your first two questions are currently being worked on and the final report will be published on the Council’s website in approximately two months’ time".

On no occasion has the council said that this report would not be available until after the remeadiation. In fact in reports conducted by Genr8 it states that a verification report would be available after the infrastructure works was completed (This was one in May).
I shall now be writing a formal letter of complaint to the councils CEO and to the information commissioner with regards to the fact that it has taken council officers so long to come to this conclusion.
