Dear Health and Safety Executive for Northern Ireland,

With the recent deaths in farming and farm related incidences/accidence and the continues bombardment of publications into farm safety and the swift action taken by our HSENI to investigate and understand the causes also grasping as much information as possible so lessons can be learnt and seemingly putting preventative measures in place so others can learn and understand from unfortunate accidents which continue to happen.

In relation to Asbestos and Asbestos related diseases according to our HSENI own publication from 2012 until 2017 the figures are clear and for every farming death there are 12 people killed by Asbestos/Asbestosis it is a slow debilitating death with a countdown timer starting at the time of exposure.

You asked five questions under the above named Act, each request and

Your request for information relating to bulletins published in the last
five years has been considered and I am not obliged to supply the
information you have requested.  In relation to this request the following
FOI exemption applies:

2)    What has been the financial cost in relation to advertisement and
public awareness for farming in the past five years?

 

Following a search of HSENI’s records I can advise that we hold the
following information relevant to your request. 

HSENI’s budget on the farm safety campaign over the last five financial
years (2013-2018) was £880k.

 

3)    What has been the financial cost in relation to advertisement and
public awareness of asbestos in the past five years?

 

Following a search of HSENI’s records I can advise that we hold the
following information relevant to your request. 

HSENI paid for articles on asbestos over the last five years totalled
£3,793.98.

 

4)    How many investigations have been carried out by HSENI in relation
to farming in the past five years?

 

Following a search of HSENI’s records I can advise that HSENI’s
agriculture and food team has carried out 95 investigations. 

 

5)    How many investigations have been carried out by HSENI in relation
to asbestos in the past five years  

 

Your request for information relating to asbestos investigations in the
past five years has been considered and I am not obliged to supply the
information you have requested.  In relation to this request the following
FOI exemption applies: 

        

·         Section 12 – Exemption where cost of compliance exceeds the
appropriate limit

 

Following an initial search of HSENI’s paper and electronic records for
the number of investigations relating to asbestos has identified a large
number of  results. This is because the topic of asbestos cuts across all
sectors of industry and is not confined to one particular area (such as
‘Farming’ or ‘Construction’). In order to accurately answer question 5)
above we estimate it would take approximately two minutes to interrogate
each record to establish if the correspondence is relevant to your
request.  We therefore estimate this exercise would exceed the appropriate
limit set under section 12 of the Freedom of Information (Fees and
Appropriate Limit) Regulations 2004.  As per guidance from the Information
Commissioner’s Office (the ICO), when estimating the cost of compliance,
the Authority can take into account the cost of the following activities:

 

·         determining whether we hold the information

·         finding the requested information, or records containing the
information

·         retrieving the information or records; and

·         extracting the requested information from records

 

It is estimated the cost of providing you with a response to question 5)
is above the amount to which we are legally required to respond i.e. the
cost of locating and retrieving the information exceeds the “appropriate
level” as stated in the Freedom of Information (Fees and Appropriate
Limit) Regulations 2004.

 

In the case of HSENI, the appropriate limit is £450 which has been
calculated to equate to a total of 18 hours of work. 

 

Excess cost removes HSENI’s obligation under the Freedom of Information
Act, however under Section 16 – Duty to provide advice and assistance, an
authority is required to offer an applicant the opportunity to redefine
their request within the cost limit.  You may therefore wish to submit a
redefined FOI request taking into accounting the breadth and scope of the
topic area.

Dear DfE HSENI FOI,

I want question 5 answered fully In the spirit of current GDPR legislation of openess and transparency being demonstrated at every level of a response. I want and I am entitled to the information to carry out a comparison, and for HSENI to demonstrate how serious Asbestos deaths are take by HSENI with figures for the amount of investigation as currently financially it is totally unacceptable.
Please provide me with this information of which I am legally entitled to, you have give me the figures for farming investigations of which I am thankful for I now simply want the same for Asbestos investigations.
Please provide your response in line with Government Ombudsman Office legislation and stop trying to conseal information.
