Please consider this to be a Freedom of Information Request under the Freedom of Information Act 2000 (‘the Act’).

I write to you in relation to a contract you awarded.

Information Requested

In accordance with s.1 of the Act, which provides a general right of access to information held by public authorities, I wish to receive the following information:

• A copy of the list of all bidders (company names) and, from those, the bidders who were successful

I request that any personal data relating to individuals is removed before this information is sent. Should the scorecards be unavailable I would request that the list of applicants only be submitted.

Use of Information

This information will be used only for RESEARCH purposes in gaining furthering understanding of the market to assist me in my studies and is not accessible by other means.

I can confirm that this information will be stored securely and used solely for the purposes for which it has been requested. I have the full support of the Information Commissioner’s Office in submitting this request.

It is not anticipated that the cost of compliance with this request will exceed the appropriate limit. Should this request be refused then full reasons must be provided in writing.

Exclusions

Please do not send personal data or financial/cost information as per S40 of the FOI Act.

Reason for applying the exemption: The release of information regarding
the identities of the unsuccessful bidders would undermine their
confidence. It could also have an adverse effect on the capabilities of
the Council to achieve best value in future tender processes

 

Public Interest Test: Whilst there is public interest in the general
principles of transparency and accountability in contractual decisions, on
balance the risk of potential commercial harm which could affect the
unsuccessful bidders outweighs the public interest in disclosure. The
public interest weighs in favour of the exemption.
