With regard to the bid races for asset support contracts in area 4 and the recent decision that will put the award process back by about 18 months.
What concerns arose that led to the decision.
Please supply detailed reasons and all supporting documentation

The Highways Agency is responsible for operating, maintaining and
improving the Strategic Road Network in England on behalf of the Secretary
of State for Transport.  This consists of the Motorway network and the
Major Trunk roads. A map of the roads for which we are responsible can be

If your email relates to an issue which is not on
the Strategic Road Network, for example a suburban, local or residential
road, you should forward your email to the relevant Local Authority who
should be able to assist you. You can find details of Local Authorities
using the search facility on the gov.uk website

If your email does relate to an issue with the Strategic Road Network it
will be passed to the relevant team within the Highways Agency and they
will respond to you within a maximum of 15 working days.

The Highways Agency are saying they may need to extend the deadline to give themselves more time to complete a public interest test as they consider the request may be subject to the exemption under FOIA 43 which says :

43 Commercial interests.

(1)Information is exempt information if it constitutes a trade secret.
(2)Information is exempt information if its disclosure under this Act would, or would be likely to, prejudice the commercial interests of any person (including the public authority holding it).
(3)The duty to confirm or deny does not arise if, or to the extent that, compliance with section 1(1)(a) would, or would be likely to, prejudice the interests mentioned in subsection (2).

It will be interesting to see what they come up with by the 6th Feb deadline.

Dear Patchett, Nicola,

with regard to your further consdieration of the 'public interest', i am at a loss to understand why, if this is such an issue, the matter could nto have been determined promptly. clearly withholding, making such a decision, is proving difficult. the inference is the HA are looking to withhold as opposed to release.

the issue must clearly be in the public interest.

when responding please detail in full the consdieraions, when they were raised and why they were nto conclude din the prescribed period.

Dear Nicola,

I note:
"The Asset Support Contracts are a key part of the Agency’s ability to successfully deliver its objectives. The HA decided to discontinue the procurement following stage 1 finance evaluation due to concern arising from elements of the pricing of the bids that in the view of the Agency will not support the delivery of the contract over the next five years. By deciding to return to ITT the Agency has created the opportunity to align the Asset Support Contract with its future needs and also the successful delivery of maintenance and improvements required between now and 2020."

Sarah, If you want to resolve this impasse you will need to take the matter up with the Information Commissioner. Howver before you can do that you need to exhaust the process with the Agency.

You therefore ask need them to carry out an "internal review "of their decision. Once they have done that and assuming they stick to there present position you can complain to the Information Commissioner.

I have been through this process and succeeded in getting information that was refused released. I could advise you further when the Agency have completed their internal review.

All you have to do is to ask them to carry out an internal review. You do not need to say why.
