However, there are occasions where it is perfectly acceptable for the constabulary to request of the applicant the reasons why the information has been requested and the purposes for which it will be used. Please explain your accusation or assumption that this is a vexatious request and how your excuse for attempted blocking is relevant to my legal and reasonable request, please also provide your evidence for making that incorrect statement.

You are obstructing a reasonable legal request and via that action preventing the course of justice.

The collar numbers referred to have abused the use of their warrant. There may be additional reasons, I have provided you one.

Dear Hampshire Constabulary,

Your have stated ''the force believes that ....'' yet you do not provide an adequate specific reason as to why you 'believe' my request to be vexatious. I would be most interested to hear your justification which to-date you have not provided.

Please provide your justification, I am not concerned about your beliefs.

Unlike yourselves I have provided an answer to your question to provide a justification for you to further answer. My response and reason to you was that the officers concerned had abused their warrant.

I therefore, in the interest of justice, and additionally for public safety reasons cannot see why Hampshire Constabulary would chose to incorrectly state that my request is vexatious. Please explain why it is bearing in mind I have provided a reason and explanation for me asking and my reason is a serious offence by the officers concerned.

By attempting to not provide an answer Hampshire Constabulary is interfering with and abusing the justice process and introducing potential public safety issues, by not answering what is a reasonable and legal request.

I look forward to you providing answers to my original request within the legal timescale required and expected.

You have stated:

In this case, the force believes that at a minimum, the following factors outlined on pages 7 - 8 of this guidance refer:
• Personal grudges
• Unreasonable persistence
• Unfounded accusations
• Intransigence
• No obvious intent to obtain information
• Futile requests

We would provide a much more detailed explanation of why we are relying on the terms of Section 14(1), but to do so in this case would disclose information which may in itself be exempt from disclosure by virtue of other exemptions contained within the Act.

All of which is incorrect. Again more of your beliefs with no factual response from your side when I have provided factual response to your previous question re why i make this FOI request.

You still have not provided reasons but a list of heading that you believe your reason or excuse for non answer is covered by. You further state that to provide a detailed explanation in this case would disclose information with may in itself be exempt from disclosure by virtue of other exceptions contained within the Act.

I state that each of the bullet points you list are incorrect and unfounded and it is for Hampshire Police to provide information as to why you believe that not to be true despite your other reason or excuse (your following paragraph after the bullet points).

You can and should and must provide enough information without disclosing information that may also conflict with the Act, to not do so will simply be providing a non justified answer with another reason or excuse for Hampshire Constabulary failing in its legal duty to answer a Freedom of Information request (which you have a legal obligation to do).

Further I have previously provided you information when requested, that answer was that the officers mentioned abused their warrant.

Hampshire Constabulary are being obstructive and possibly putting public security at risk by their protection of these officers. Hampshire Constabulary appear to have taken a stance re this request rather than to simply answer this clear FOI request.

To your bullet points above you should now answer each one, in addition to my original question, whilst at the same time not compromising the Act with further revelations. This is your problem, not mine.

As it stands now your response is simply a bullet list of totally unfounded accusations against the person asking the simple original questions. You have provided no answers at all and attempt to provide further reference to the Act to justify not doing so.

I look forward to you answering my original questions and also providing a reason and details to each one of the bullet points you have created and referred to. As mentioned, providing any additional information that may compromise your position is entirely your problem and issue and not mine. I suggest you word your response carefully to answer my questions and not compromise yourselves. Please don’t make your issues our issues or attempt to engineer that as another reason for not answering, which is what it appears you have done or you are attempting to do.

As it stands now, Hampshire Constabulary have been informed that two of their officers have abused their warrant and your department appears not to be protecting those officers. Hampshire Constabulary are being illegally and unreasonably obstructive to this FOI request. The public will draw its own conclusions by your failures to answer and your failures to provide justification for not doing so.

I am writing to request an internal review of Hampshire Constabulary's handling of my FOI request 'Are the following two collar numbers currently deployed at Hampshire Constabulary?'.

I have provided a reason, which was requested. That reason was 'abuse of warrant' and yet the information is still withheld.
I have referred to collar numbers throughout and not names, these officers have not been identified personally (which is correct).
There is no reason to withhold this information, the police answer to the public and police by consent. The implications of 'protecting' the identity of police officers who may have committed a crime are serious. This should be reviewed.
