Dear British Broadcasting Corporation,

Could you please clarify the following information.
in the application form for
" Accomodation for Residential Care (ARC)Concessionary TV licence (ENGLAND AND WALES)

section 6
states the following.

Please list: All residents aged 74 years and under,including details of any residents who do not have a television.
Only residents aged 74 and under should be listed in the table below.It is also necessary to indicate any vacant units,units used as RESPITE CARE rooms or GUEST rooms. In respect of these types of units only provide the flat or room number,address details and whether there is a TV or not.

can you please answer my following questions.

1) What is your definition as a RESPITE CARE room ,i.e. who is allowed to stay there as stated in the legislation.and is a TV licence fee payable for a TV in this room .

2) If included in a ARC residential TV licence how many rooms are allowed for it to be included in the ARC licence

3 ) What is your definition as a GUEST room,i.e. who is allowed to stay there as stated in the legislation and is a TV licence fee payable for a TV in this room .

4) If included in a ARC licence how many rooms are allowed for it to be included in the ARC licence.

5) Can you show me the Government legislation individually for each of the following rooms if they are both included or not included in a ARC licence

6) Respite room.

7) Guest room.

I am writing to request an internal review of British Broadcasting Corporation's handling of my FOI request 'ARC Licence information'.

Again and again I have asked a question but it has been evaded by not answering it but pointed to some 2004 legislation I would like to point you to information on YOUR OWN websites that clearly shows respite and guest rooms are two entirely different types of accomodation,nowhere in any of your information dose it state that if have more than one guest room a ARC Licence will be refused on the contrary it states guest ROOMS( useing plural) have to pay a full to licence.

1) states a respite room included in ARC Licence

What the Accommodation for Residential Care (ARC) Concessionary TV Licence covers
The ARC Concessionary TV Licence allows qualifying residents, as well as members of their household and guests, to install and use TV receiving equipment in the qualifying resident's unit of accommodation or dwelling. The unit of accommodation or dwelling must be listed on the licence and the £7.50 fee must have been paid for that unit or dwelling.
From 1 April 2007, a respite room may be included in the list of units of accommodation. An occupant of a respite room will be covered by the ARC Concessionary TV Licence providing:
The resident is retired (and aged over 60) or disabled, and
The respite room is listed on the licence, and
The £7.50 fee has been paid for the licence.
In this case "retired" means any person who is aged 60 years or more and, if they work:

2) Clearly shows a guest room and respite room are two different types of accomodation.

States from 1st April 2007 a RESPITE ROOM ,will be covered by ARC licence.

Clearly states respite OR guest rooms indicating two different types of accomodation.

3) States that unlike Respite room guest ROOMS have to have a full licence not that only allowed one guest room to qualify for a ARC licence.

SECTION 2.2: DETAILS OF CARER (e.g. warden/scheme manager)– To be completed for SHELTERED/SUPPORTED ACCOMMODATION onlyName of carer (e.g. warden/scheme manager): Address of carer’s accommodation:Postcode:Contact telephone number:IMPORTANT NOTE: TVs in communal rooms, guest rooms and resident staff accommodation are NOT covered by the ARC concessionary TV Licence.

This states clearly that guest rooms are not covered by the ARC TV licence differentiating it from a respite room.

The rules do not state anywhere that if you have more than one GUEST room you will not be allowed a ARC licence I have asked for you to show me this and keep being pointed to 2004 legislation.?
