The information you have requested is therefore technically withheld under
section 21 of the FOIA which explains that we are not required to provide
information in response to a request if it is already reasonably
accessible to you from another source.
 
I can advise that the Safeguards Policy was approved in December 2018 by
the ICO’s Data Protection Officer with input from our policy and legal
departments.

I am writing to request an internal review of Information Commissioner’s Office's handling of my FOI request '"Appropriate policy document"'.

My request asked for the date that the appropriate policy document was approved. You have not provided this information.

Furthermore, my request was made on 30 November 2018. If, as you say, the document was approved in December 2018 you cannot rely on the S.21 exemption as it was not reasonably available via another means.

I asked who approved the document, and by which process this occurred. You have not provided this information.

My colleague Sarah Whelan wrote to you on 21 December 2018 and confirmed
to you that we held information that fell within the scope of your request
and advised that whilst this fell within a Section 21 exemption under the
Freedom of Information Act, she gave you the appropriate links to the

Ms Whelan also advised that the policy was approved by our Data Protection
Officer in December 2018 by our Data Protection Officer.

Our internal review
 
I have reviewed your information request response as requested on 2
January 2019. I can confirm that the date the policy document was approved
was 20 December 2018, as previously stated, this was approved by our Data
Protection Officer further to input from our policy and legal teams.
 
In relation to your complaint that we should not have applied a Section 21
exemption as the information was not available on the date of your
request: I partially uphold your complaint in this regard, this
technically should not have been applied. However, in the interests of
providing advice and assistance Ms Whelan provided you with the
information you sought rather than replying that the information was not
held at the time of your request. Your request for a review of this
decision in the interests of transparency and in order to be helpful and
provide you with what was requested is bordering on the frivolous use of a
formal procedure. I am satisfied you have the information you requested
and consider the matter closed.

formal complaint with the ICO in its capacity as the regulator of The
