I am writing to confirm that we have now completed our search for the
information you requested on 24 July 2020.

 

The Appraisal Summary Tables (AST) for the following road schemes are
provided as attachments. Personal details have been removed, in reliance
Regulation 13 of the Environmental Information Regulations Act 2004.

 

 1. M54-M6 Link Road
 2. M42 Junction 6
 3. A46 Coventry Junctions (Binley & Walsgrave)
 4. A47 North Tuddenham to Easton  - An updated Appraisal Summary Table is
expected to be produced later this year.
 5. A47 Blofield to North Burlingham - An updated Appraisal Summary Table
is expected to be produced later this year
 6. A47 Great Yarmouth Junctions - The scheme is currently under review in
light of the new Great Yarmouth third river crossing

The A120 Tendring / Colchester Borders Garden Community (HIF) and A12
Colchester / Braintree Borders Garden Community (HIF) are being delivered
by the Local Authorities, therefore under Regulation 12(4)a, we are unable
to provide this data as we do not hold it. Please request this directly
from the local authority in the area concerned.

 

In relation to A46 Newark Bypass and A5 Dodwells to Longshoot, we are
still in the process of investigating the latest Appraisal Summary Tables
and expect to provide a response by the 1 September 2020.

 

There are no links to where the information is publicly available,
therefore under Regulation 12(4)a, we are unable to provide.

 

In reference to your e-mail on 22 August 2020, I can confirm that the
response was not due until 24 August owing to the August Bank Holiday in
Scotland on 3 August. Whilst this is only a bank holiday in Scotland,
under the Freedom of Information Act 2000, any bank holiday in any part of
the United Kingdom is classed as a none working day for the other nations.
Therefore, the deadline for your request factored in this bank holiday
making the due date the 24 August 2020 and not the 21 August.

 

If you are unhappy with the way we have handled your request you may ask
for an internal review within 40 days for Environmental Information
Regulations requests.

Further to our response dated 24 August 2020, I can confirm that we have
now completed our investigation for the A46 Newark Bypass and A5 Dodwells
to Longshoot schemes and have decided not to disclose their Appraisal
Summary Tables (AST) at this time.

 

The information being withheld falls under [1]Regulation 12(4)(d) of the
Environmental Information Regulations 2004 because the material is still
in the course of completion.

 

We consider exception 12(4)(d) to apply because the data within the AST’s
is likely to change as further research is being undertaken and to release
the requested information at this stage could be misleading, cause
unnecessary concern and require a disproportionate effort to correct that
view.  

 

In applying this exception we have had to balance the public interest in
withholding the information against the public interest in disclosure. The
key public interest factors for and against disclosure are attached above.

I am writing to request an internal review of Highways England Company Limited's handling of my FOI request 'Appraisal Summary Tables (ASTs) for road schemes in RIS2'. Specifically of your refusal to publish the Appraisal Summary Tables for the A46 Newark Bypass and A5 Dodwells to Longshoot schemes using exception 12(4)(d).

This exception relates to unfinished and incomplete data. I believe you have misapplied the exception, and that this exception is not engaged. There is nothing in your response to indicate that the ASTs are NOT complete. You claim that "the data within the AST’s is likely to change as further research is being undertaken and to release the requested information at this stage could be misleading, cause unnecessary concern and require a disproportionate effort to correct that view."

Your response indicates that the ASTs are complete, but other ASTs may be produced during these scheme's development and will replace the existing ASTs which I am requesting.

ICO guidance on exception 12(4)(d) clearly shows that the ICO believes that just because a final version of a document may be produced at a later date, the drafts must be released if requested, and this exception is therefore not engaged (Secretary of State for Transport v the Information Commissioner (EA/2008/0052, 5 May 2009) and Mersey Tunnel Users Association v the Information Commissioner and Halton Borough Council (EA/2009/0001 Stage 2, 11 January 2010): https://ico.org.uk/media/for-organisatio...

The ICO guidance also states that "where an authority is using or relying on data at the time of the request, then it cannot be considered incomplete simply on the basis that it may be modified or amended in the future".

The ICO also state in their guidance that "We are sceptical of arguments that information should not be disclosed because it would give a misleading or inaccurate impression".

Highways England have already released ASTs for approximately 40 road schemes, dated from 2016 to 2020. Some of the ASTs are complete, some of them with missing information. There is no consistency or logic in withholding these two ASTs when all the others have been released.

The public interest lays in publishing the ASTs for these schemes, to aid public understanding of Highways England's current estimation of the key economic and environmental impacts of these schemes. Furthermore, under regulation 12(2), Highways England must apply a presumption in favour of disclosure.
