Appointment of Head of Administration and Law

From 2011 until early 2015 the council's Head of Administration and Law/Monitoring Officer was employed in an 'acting' capacity.
From early 2015 the position was made permanent and the word 'acting' was dropped.

According to the council's Constitution this appointment must be made by Appointments Committee 'B'. Please provide minutes of meetings, either from Appointments Committee 'B' or any other committee or meeting where this was discussed and the position made permanent.

I refer to your request for information regarding the appointment of Head of Administration and Law.

The specific information you requested was set out in your email below.

In response, whilst the Council's Constitution states that the function of appointing a Head of Service sits with the Appointments Panel 'B', under normal recruitment circumstances, the Constitution also refers to the Scheme of Delegation. This authorises the Chief Executive and Directors to make arrangements for the proper administration of the functions falling within their responsibility, provided that in exercising diligent powers the officers comply with any statutory provision, the Council's Constitution and the Council's Policy Framework etc.

The relevant policy in this case was the Council's Organisational Change Policy, the scope of which includes all Council employees apart from staff on the complement of locally managed schools, and which stipulates that 'employees who have been seconded for more than 2 years within a post may be eligible to be confirmed in post'.

In your request, you have referred to the fact that Ms Rees-Jones was employed in an 'acting' capacity since 2011. As such, Ms Rees-Jones' secondment exceeded the 2 year period required by the Organisational Change Policy to be considered for confirmation in post. Ms Rees-Jones was therefore confirmed in post in accordance with our agreed Policies and Procedures, and this did not require Appointments Panel 'B' to be convened. We do not hold the information you are seeking, therefore.
