Applying for Indefinite Leave to Remain: will curtailment notice affect my application

We're waiting for J Chucas to read recent responses and update the status.

Dear Home Office,

I have been in the UK since February 2012 under Tier 2 Visa and is now hoping to apply for Indefinite Leave to Remain. However, last year May 2016, I received a curtailment letter as my employer went into administration and was taken over by another company. Unfortunately, the new company failed to transfer our sponsorship and therefore the curtailment notice was served to till 31 July 2016. I successfully applied for a new Tier 2 Visa in another company before the said expiry date and received my new BRP on 2 Aug 2016.

My query is will this affect my application for ILR? I have read that you need 5 years of continuous employment. Am I in breach of this condition?

Please advise. Thanks

Yours faithfully,

Jane

UK Visas and Immigration,

Dear Jane,

Thank you for your enquiry dated 22nd August regarding an application for
ILR.

To apply for settlement (ILR) in the UK you can not have any breaks in
your 5 years continuous employment.  If you already had an application for
your new tier 2 visa in progress before the curtailment was served then
there will no no issue with you applying for your indefinite leave to
remain status.
