Dear Student Loans Company Limited,
Please provide, broken down by year and by different listing below for the last 5 years, the number of applicants falling under each of the below categories:

-Asylum seekers
-Indefinite leave to remain
-Discretionary leave to remain
-UASC leave to remain
-limited leave to remain
-Humanitarian protection
-Refugees

Please also provide data for the number of these applications which resulted in student finance being granted, and the number of cases in which it was rejected by the SLC. It is not necessary to provide outcomes data for cases where a decision stage was not reached.

If any of these categories are currently held within a single larger category within internal coding by the SLC for data storage, I am happy for the SLCs own data category to be returned so long as an explanation of which groups it covers is provided, and that the category primarily consists of individuals from within the above groups.

Before progressing your request, we would be grateful if you could clarify
if you are seeking data for all student finance applications, irrespective
of UK funding authority.  Please note that SLC holds application data for
England, Wales and Northern Ireland, but not Scotland.  In addition, SLC
does not assess applications submitted to Student Finance Northern
Ireland, as this is done by the Education Authority.  For Student Finance
Wales, SLC has not assessed applications throughout the 5 year period you
have requested.  

If you could consider the above and advise of your specific requirements.

We will respond to you under the terms of the FOIA and within 20 working
days.

We will contact you further for clarification of your request if this is
considered necessary.

Dear Mr Brawley

I refer to your recent email dated 08/02/2018 requesting the following
information under the Freedom of Information Act 2000 (“FOIA”):

By email dated 20/02/2018 you clarified your request as follows:

“I'm content to restrict my requests to England for ease of production and
consistency of the data.”
Response

I can confirm that the Student Loans Company Limited (“SLC”) does hold
information falling with the scope of your request.  However, having
reviewed your request and in consultation with the appropriate departments
within SLC I have concluded that this information cannot be released as
the cost of complying with your request would exceed the appropriate limit
set out in the Freedom of Information and Data Protection (Appropriate
Limit and Fees) Regulations 2004.  The limit applying to us is £450 or 2.5
days (calculated to be 18 hours of staff time at £25 per hour).

The information is therefore exempt under section 12(1) of the FOIA and in
accordance with section 17(1) of the FOIA this letter constitutes a
Refusal Notice in respect of your request.

By way of explanation, SLC does not record each of these protected
statuses separately, only humanitarian protection and refugees as these
are specific questions in the Student Finance England (“SFE”) application
form (2017/18 form available at

specific categories of eligible student –under paragraphs 4 and 5 of
Schedule 1 to the Education (Student Support) Regulations 2011, as
amended.  To provide data for the other protected characteristics would
exceed 18 hours of staff time.  The relevant application questions can be
found in section 3 of the application form:

·        Do you have ‘settled status’ in the UK?
·        Have you or your:
o        husband, wife, civil partner; or
o        parent(s), step-parent been granted ‘refugee status’ by the UK
Government?
·        Have you or your:
o        husband, wife, civil partner; or
o        parent(s), step-parent been granted Humanitarian Protection?

Although ‘settled status’ is defined in the application form notes
([2]http://media.slc.co.uk/sfe/1718/ft/sfe_p...) some
applicants will answer “yes” to this question if they have a leave to
remain other then Indefinite Leave to Remain.  

Please find the data associated with these questions attached, broken down
by status as stated on the application form for academic years 2012/13 to
2016/17 (academic year 2017/18 is not yet complete so the last 5 complete
years have been provided.  Please refer to the notes and caveats
associated with the data.  By way of explanation of the data, for academic
year 2016/17, 240 applications were approved for payment from those who
answered “yes” to question b4 in section 3 (humanitarian protection),
while 1,170 were not approved, and of those not approved 290 were
ineligible – the  others would be where the application was incomplete or
cancelled.

Internal review process

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review.

Internal review requests should be submitted within two months of the date
of receipt of the response to your original request and should be
