Application of genuine vacancy test for Skilled Worker CoS applications - care sector
Dear Home Office,
There is publicly available information, confirming that at least some employers'/sponsors' applications for Skilled Worker visa Certificates of Sponsorships (CoS) in the care sector have been subject to the genuine vacancy test. For example, this is confirmed in the following High Court judgment - https://www.bailii.org/ew/cases/EWHC/Adm....
Could you please provide the following with regards to the abovementioned application of the genuine vacancy test:
1) Any policy or policies that caseworkers should follow in considering Skilled Worker visa CoS applications in the care sector, which regulate or dictate the application of the genuine vacancy test.
2) Any other policies that outline the Home Office's approach with respect to the application of the genuine vacancy test for such CoS applications in the care sector.
