Michael Gaffney

Dear Stuart,

I understand that the Traffic Penalty Tribunal isn't strictly required to comply with FOI requests under the Freedom of Information Act 2000, but if you could help me with this request I would greatly appreciate it.

I would like to know:

A) How many appeals the Traffic Penalty Tribunal has received regarding charges for use of the A533 Mersey Gateway Bridge & A577 Silver Jubilee Bridge since 14th October 2017, and how many of these appeals were successfully allowed?

B) How many appeals the Traffic Penalty Tribunal has received regarding charges for use of the A533 Mersey Gateway Bridge & A577 Silver Jubilee Bridge since 11th March 2019, and how many of these appeals were successfully allowed?

Yours faithfully,

Michael Gaffney

Stuart Wilson, Traffic Penalty Tribunal

Dear Mr Gaffney

Thank you for your enquiry.

Please note that the Adjudicators (known as the Traffic Penalty Tribunal)
appointed under the powers in the Traffic Management Act 2004 are not
within the definition of a "public authority" in schedule 1 of the Freedom
of Information Act 2000. Consequently, the duties created by that Act do
not apply to the Adjudicators.

The figures for the Mersey Gateway Bridge are as follows:

Since the 14 October 2017 to date 12,901 penalty charge notices(PCNs) have
been appealed, of which 2,159 have been Allowed.

Between 11 March 2019  and today, 5,559 PCNs have been appealed of which
559 have been Allowed.

The Silver Jubilee Bridge is not yet open.

Yours sincerely

Stuart Wilson
