Appeal decisions concerning Duke Street Bus Gate, Duke Street, Chelmsford.
Dear Traffic Penalty Tribunal,
Please can you provide me with copies of adjudication decisions made by the Traffic Penalty Tribunal in 2018 and 2019 up until this date - 08/02/2019 - in relation to appeals against fines issued for a contravention of the bus gate on Duke Street in Chelmsford, Essex.
I am particularly interested in receiving copies of a recent decision upholding an appeal made by a Dr. Bernadine King, as publicised by BCC Essex Radio, and here: https://www.bbc.co.uk/news/uk-england-es....
Yours faithfully,
Charles Thomson
Dear Mr Thomson
Thank you for your email.
Please note that the Adjudicators (known as the Traffic Penalty Tribunal) appointed under the powers in the Traffic Management Act 2004 are not within the definition of a "public authority" in schedule 1 of the Freedom of Information Act 2000. Consequently, the duties created by that Act do not apply to the Adjudicators.
The Traffic Penalty Tribunal will supply a maximum of five appeal decisions on request on a discretionary basis, giving consideration to whether it is proportionate to the resources needed to find and redact the decisions.
I have attached the five most recent appeal decisions for the location you have specified, including the King decision.
Please note that these decisions will not necessarily all have been decided on the same issue, that past decisions do not set a precedent and that each decision is decided on the facts.
Yours sincerely
Stuart Wilson
