Dear Mr White

Further to our acknowledgement dated 4 August 2010 we are now in a
position to respond to your request for information submitted under the
Freedom of Information Act.

On 3 August 2010 you requested the following information:

“Please disclose any communications with Talk Talk in the last year in
regard to any new services they propose to provide to their broadband
customers

    

Please disclose any meetings with Talk Talk in regard to any new    
services they propose to provide to their broadband customers. If any
meeting have taken place then please disclose the subject

matter, agenda and minutes of these meeting”

In response to your request please find attached a document that includes
the following:

o Guiding questions for meeting with Talktalk
o Draft letter to Talktalk
o The Commissioner’s letter to Talktalk dated 30 July
o String of emails between Talktalk and Mr. David J Evans of the ICO
o A response letter from Talktalk to Mr. Christopher Graham, the
Commissioner.

Please note that we have removed the names and contact details of staff
from Talktalk under section 40 (2) of the FOI Act by virtue of section 40
(3) (a) (i) of the same Act. An explanation will follow below.

    

As this information relates to identifiable individuals it constitutes
their ‘personal data’. We have therefore considered whether the
disclosure of this personal data is subject to the exemption at section
40(2) of the Freedom of Information Act 2000 (by virtue of s40(3)(a)(i)).
If the disclosure of the personal data would contravene any of the eight
data protection principles contained within the Data Protection Act 1998
the exemption at section 40(2) of the Freedom of Information Act 2000 will
apply.

It is unlikely that it would be within the expectations of these
individuals that their names and contact details be put into the public
domain, as they will have provided these details for internal use within
the ICO. Therefore disclosure would be in contravention of the first Data
Protection Principle. This requires personal data to be processed
‘fairly and lawfully’. It is therefore appropriate for us to withhold
this information under section 40(2) of the Freedom of Information Act
2000 by virtue of section 40(3)(a)(i). This section of the Act states:-

“(2) Any information to which a request for information relates is
also exempt information if

a) it constitutes personal data which do not fall within subsection
(1), and

b) either the first or the second condition below is satisfied.

(3) The first condition is –

a) in a case where the information falls within any of paragraphs (a)
to (d) of the definition of “data” in section 1(1) of the Data
Protection Act 1998, that the disclosure of the information to a

             member of the public otherwise than under this
Act would     contravene –

i. any of the
data protection principles …”

We have also withheld the name of a member of staff from the ICO.  This
name has been withheld in accordance with our policy not to identify
members of staff of level C or below (i.e. those posts that equate to the
Treasury Grade of Executive Officer, Administrative Officer and
Administrative Assistant), unless the post is a public facing one.

At the time of receiving your request, no information was held in relation
to meetings with Talktalk regarding new services they propose to provide
to their broadband customers. However, we had a meeting with Talktalk on
16 August 2010. As the meeting took place after the date of the receipt of
your request, we have not considered any information relating to it for
release on this occasion. Should you require information in relation to
this meeting please put a new request to

Please also find attached a copy of a document entitled Anti-Malware
System Summary. This document that has been provided to us by Talktalk in
response to the Commissioner’s letter and the meeting we had with them
on 16 August 2010.

As a result, the Home Office confirmed that they did NOT meet with TalkTalk to discuss the malware prevention system prior to its implementation.
