Essex Police refer to your recent request logged under the above reference
and subsequent acknowledgement. 

 

The Freedom of Information Act 2000 (FOIA) obliges us to respond to
requests promptly and in any case no later than 20 working days after
receiving your request.  

 

We must consider firstly whether we can comply with Section 1(1)(a) of the
Act, which is our duty to confirm whether or not the information requested
is held and secondly, we must comply with Section 1(1)(b), which is the
provision of such information.  However, when a qualified exemption
applies either to the confirmation or denial or the information provision
and the public interest test is engaged, the Act allows the time for
response to be longer than 20 working days, if the balance of such public
interest is undetermined. 

 

We wish to advise you that the following exemption is engaged in relation
to your request:   

 

Section 31 Law Enforcement  

By virtue of Section 31(1)(a)(b) or Section 31(1)(b), where public
authorities have to consider the balance of the public interest in
relation to a request, they do not have to comply with the request until
such times as is reasonable in the circumstances.   

 

This is a qualified exemption and there is a requirement to conduct a
public interest test.  Essex Police is obliged to consult with all
stakeholders who may be affected by the force complying with your
request.   

 

Upon completion of this process, we are then required to ascertain where
the balance in compliance with both our duty to confirm or deny what
information exists and/or in disclosure of any relevant information.   

 

This process is ongoing and when considering these matters, we are
entitled to extend the deadline for complying with your request.   

 

Unfortunately, this does mean that Essex Police will not be able to
respond to your request in full within 20 working days of the original
receipt.   

 

The new estimated date for compliance will be 24/04/2024.  If it appears
that it will take longer than this to reach a conclusion, you will be kept
informed.   

 

Please accept our apologies for any inconvenience that this may cause, we

Notes:

A query was done on all Home Office Classification NC/10 crimes and
non-crimes between the Created dates of 01/01/2023 and 31/01/2024 as
requested.

Two separate results tabs were created with filters to bring back only
‘Hate Incident – Religious – Jewish’ type in both but Offence
Investigation Type ‘CRIME in one tab and ‘NONCRIME’ in the other tab.

Pivot tables were created to draw out the results split by
Crime/Non-Crime, created month/year, and the districts specified.

The results are on two tabs, Antisemitic hate crime and Antisemitic hate
non-crime. Both are broken down by year, month, and district.

volume by month and by District has the potential to identify individuals.
