I acknowledge receipt of your email dated 23 April 2019 in which you have
asked to be provided with the latest waiting list view, related scores and
inner catchment vs. Designated area information for all girls up to 100th
place on the waiting list for year 2019 entry.

 

I have very carefully considered your request and I consider that the
information you have requested is exempt from disclosure under exemption
36 (c) of the Freedom of Information Act 2000 on the grounds that
disclosure would be likely to prejudice the effective conduct of the
School’s public affairs.

 

When deciding on the application of this exemption, the School has
obtained the reasonable opinion of the Chair of the Governing Board, Mr
Fazl-E Hasnain, who is the relevant ‘qualified person’.  It is the
reasonable opinion of Mr Hasnain that the information is exempt under
section 36 (c) because:

 

(a)    The School is a grammar school which is legally permitted to select
intake on the basis of academic ability

(b)    The School provides an individual score of a girl on the waiting
list when requested by the relevant parent

(c)     The School does not provide score information to anyone else,
other than noted in (b) above

(d)    If the School were to disclose anonymous information about the
scores of girls on the waiting list, it could give an unfair advantage to
those who have this information as it could give them an insight into how
the tests are marked and standardised

(e)    Such disclosure would undermine the rigour of the tests themselves
as the integrity of the admissions test process is fundamental to ensuring
the process is conducted in a fair manner and would therefore prejudice
the effective conduct of public affairs

 

As this is a qualified exemption, I am also required to consider whether
it is in the public interest to disclose the information requested. Under
section 10(3) of the Freedom of Information Act 2000 I am extending the
time limit in order to make such considerations.  I will therefore inform
you of the outcome of my considerations within 20 school days of this
email.

Further to your Freedom of Information request, dated 23 April 2019, for
the latest waiting list view, related scores and inner catchment vs.
Designated area information for all girls up to 100th place on the waiting
list for year 2019 entry, I am writing to inform you of the outcome of the
public interest test.

 

On 20 May, I informed you that the information you have requested is
exempt from disclosure under exemption 36 (c) of the Freedom of
Information Act 2000 on the grounds that disclosure would be likely to
prejudice the effective conduct of the School’s public affairs. As this is
a qualified exemption, I have also considered whether it is in the public
interest to disclose the information requested and, on balance, I have
concluded that it is in the public interest to maintain the exemption.  I
have considered that there may be a public interest in promoting
transparency by providing contextual information to individual parents
about their child’s position on the waiting list through the publication
of the scores of anonymous students on the waiting list.  However, I
consider that this is outweighed by the need to ensure that the integrity
of the admissions process is maintained, given that we are a publicly
funded school which is significantly oversubscribed. 

 

As such taking into account the above, in these circumstances I am afraid
I am unable to agree to your request.

 

If you are dissatisfied with the way your request has been handled, you
may ask me to review my decision in the first instance, by writing to me
within 20 school days of receipt of this letter requesting a review.  If
you remain unhappy after that, you have a right of appeal to the
Information Commissioner at the Information Commissioner's Office,
Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF, telephone number
0303-123-1113 (local rate) or 01625-545745 (national rate).  There is no
charge for lodging an appeal.
