Please confirm that you are asking for the following information:-

Is the Council aware of whether any owner of land in its area, which is also a 'pay and display' public car park, sues for trespass any owner of a vehicle who has parked there in breach of the rules? If so, identify them.

Dear FOI, I am unable to clarify in respect of your clarification as I cannot comprehend its requirement.

It is ny understanding that failure to pay a parking fine of any sort, is claimed as a tort for an alleged breach of an implied contract. As the claim of tort can only be made by the land owner (man or Woman)by suffering loss or harm. My simple request is that the man or woman who is the owner of the land known as council land or public land be identified. You will of course be aware that the Council (being a corporate 'dead entity) cannot make a claim as it has no life.

Answer:-

 

The County Council, being a creature of statute, must have statutory
authority to undertake activities and so could not claim a fee for parking
unless there was statutory authority to do so hence all council owned car
parks are designated under the relevant legislation, being the Road
Traffic Regulation Act 1984.

Your response:

The parking charge or fine imposed by the Council  is authorised by
legislation - it is not claimed as damages for trespass.

Therefore, there is no "name" other than "the Council" that can be
provided to you.
