Further to your recent request for an internal review to your initial FOI
enquiry sent on 16th February, I have reviewed your request and can
respond as follows.
In terms of the original FOI request, I can confirm that the response to
your original FOI, which we received on 16th February 2024, was responded
to on the 12th March 2024, within the 20 statutory days allowed within the
legislation.
Before responding to your specific issues, I would point out that in
responding to any requests under Freedom of Information legislation we are
obliged only to confirm or deny that we hold information, and, if we do
hold it, whether there are any exemptions within either the FOIA or data
protection legislation which it is appropriate to apply in refusing to
provide the information. Further, Freedom of information legislation does
not generally require a public body to create (ie seek additional)
information in response to a request, over and above that which we already
hold as an organisation.
I now turn to your specific requests which were as follows:
1. What is the per case fee that is charged by London Tribunals to local
authorities for a case during 2023?
2. Is the fee different if the authority does not submit evidence and
therefore concedes the case/does not contest the appeal?
3. How much of the revenue of London Tribunals during 2023 came from fees
charged on a per case basis and how much came from other means eg cost
charges to councils which are not on a per case basis?
4. Please specify how the share of each council is decided for the
fees/income which are not on a per case basis?
The response that you received informed you that all the financial
information requested was contained in a report, a link to which was
provided.
On reviewing the response you are correct in stating that the Revenue
Budget and Borough Subscription & Charges Report 2024/25 you were directed
to on the London Councils website did not include information to some of
the above mentioned questions.
In answer to your request for information, I set out below a revised
response.
1. What is the per case fee that is charged by London Tribunals to local
authorities for a case during 2023?
This information is contained in the Revenue Budget and Borough
Subscription & Charges 2024/25 report submitted to the Transport &
Environment Committee meeting dated 7 December 2023, the link to which was
provided in the initial response to your FOI. Please see table 4 in item
7.
2. Is the fee different if the authority does not submit evidence and
therefore concedes the case/does not contest the appeal?
This information was not contained in the report you were previously
referred to. I can confirm that there is no difference to the unit charge
to a London Borough if the authority does not submit evidence/does not
contest the appeal.
3. How much of the revenue of London Tribunals during 2023 came from fees
charged on a per case basis and how much came from other means eg cost
charges to councils which are not on a per case basis?
Paragraphs 30 to 33 of the report you were previously referred to explains
the general funding for London Tribunals rather than the specific funding
for 2023. For the 2023 funding please see the link below to the Revenue
Budget and Borough Subscription & Charges 2023/24 report submitted to the
Transport & Environment Committee meeting dated 8th December 2022 (see
paragraph 16 & 17 of item 12 on the agenda):

For clarity, £1.273 million of the £3.496 million funding of London
Tribunals for 2023 is covered through a contract with the GLA/TfL in
respect of road user charging appeals and ULEZ with the remaining costs,
£2.223 million, apportioned through the penalty charge notices issued by
boroughs and TfL. All of the borough contributions to funding London
Tribunals is raised through the unit charge per PCN.
4. Please specify how the share of each council is decided for the
fees/income which are not on a per case basis?
