Analysis of highways maintenance costs

Please refer to page 7 section 11 of the Summary of the National Audit Office's report dated 1th December 2011 entitled “Reducing costs in the Department for Transport” it can be accessed via this link:

Dear Steve Berry,
The NAO report was dated December 2011. The paragraph describing the report said:
"The Department commissioned a bespoke analysis of the relative benefits and costs of national highways maintenance, as information here was weaker (as previously identified in our 2009 report on Contracting for Highways Maintenance)"!.
Please note "commissioned" is in the past tense.
In your letter of 22nd July you refer to a study commissioned in 2013 implying this was the report I had requested. The two are clearly not the same.
You have therefore failed to comply with FOIA 1(1) by not confirming or denying you hold the information requested and, if so, providing me with a copy within 20 working days.
As this is an irreversible procedural breach I am writing to the Information Commissioner requesting he issues a Decision Notice to this effect.
In the meantime please carry out an internal review of the way you have handled my request.
