Allotments s106
Dear North Norfolk District Council,
As part of a planning application (PF/17/1802) NNDC has negotiated an s106 the provision for offsite allotments.
Please could NNDC supply copies of all correspondence (email/letters) under taken by NNDC that relate to the s106 negotiations of these allotments as a community benefit.
This includes inter department correspondence at NNDC plus all correspondences between NNDC and all third parties named in the Heads of Term agreement.

Thank you for your request for information. The majority of the
information you have requested is available on our website as follows:
Application PF/17/1802 is a slightly amended version of the application
PF/17/0696 which was considered by planning committee on 3^rd August and
31^st August 2017 and continues to propose the same provision for
improving allotments off-site as was proposed and endorsed by Officers in
the last application. The 2008 Local Development Framework and Open Space
Needs Assessment (both public documents at the Policy section of the NNDC

Please find attached relevant correspondence in this respect. The Council
has not released one email that refers to commercially sensitive
information in the applicant’s viability appraisal. This is exempt from
disclosure under regulation 12(5)(e) of the Environmental Information
Regulations 2004 and would affect legitimate economic interests at this
time if this is released. Having considered the public interest test it
is our decision to withhold this information. This is because the
Council believes that withholding the information requested outweighs
that in disclosing it as this would have a detrimental effect and could
compromise the project at the moment.

I would like to seek clarification as to why NNDC has not responded to the FOI request properly. The information sent (while is at a stretch relevant) the request has in no way been followed.
The allotments facet of the s106 is a new element to the s106. The purpose of the FOI question is how this benefit was conceived and between whom was it negotiated?
The FOI request ask for supply copies of
1. "all correspondence (email/letters) under taken by NNDC that relate to the s106 negotiations of these allotments as a community benefit."
This has not been done in NNDC response.
2. This includes inter department correspondence at NNDC plus all correspondences between NNDC and all third parties named in the Heads of Term agreement.
This has not been done in NNDC response.
It would appear from the information on the portal and the information provided in the none response that the allotment idea is a community benefit popped out of thin air . Correspondences and negotiations must exist between NNDC and third parties that bring this community benefit to fruition.
Consequently, can you please fulfil the Freedom of Information request with delay.

I am really quiet surprised to write to NNDC for a 3rd time. I protest strongly that my original request is being treated as a new FOI. This creates another 20 day waiting time. The original FOI clearly ask for the information that has not been provided in NNDC's response.
I request an internal review of NNDC's procedures and ask that my original request be answered without delay.
