I am writing to request an internal review of Brighton and Hove City Council's handling of my FOI request 'Allotments Officer Job Description'.

I did not receive a satisfactory answer to my question;

3/ Whether the successful applicant had the job related education, qualifications and experience listed as 'Essential Criteria' on the job description.

Did the successful applicant have;

•Substantive 3 years work experience in grounds maintenance, horticulture and/or landscape gardening.

•A recognised qualification in horticulture or related subject (Degree, diploma, City and Guides, NVQ – includes RHS)

•A full driving licence.

These are listed as 'essential criterea' on the application, plot holders in Brighton would like to know if the person employed to run their service has the essential criteria for the job.

This seems to me to avoid answering the key question on which information was requested - namely, does the chosen candidate possess the essential criteria listed? I am also surprised at the low number of external applicants - is this post ringfenced for internal candidates? If not, where was it advertised that resulted in a response rate of one for a job which might be expected to attract many well qualified candidates?

Thank you for your below email appealing your recent FOI request response
that you received.

 

Your appeal asks:

 

3/ Whether the successful applicant had the job related education,

     Did the successful applicant have;

Response:

 

The response to your original FOI request was that Council appointments
are made on merit, following an interview process, during

which all shortlisted candidates were assessed against the essential
criteria for the job.

 

The disclosure of experience and qualifications of any individual is
deemed by the Council to be personal data that cannot be disclosed to

3^rd parties, i.e. other people other than the subject themselves.

 

Under the Data Protection Act 1998, the Council has a duty to process
personal information lawfully and that disclosure would be a breach of the
Data Protection Act.

 

As such, the information requested is exempt from disclosure under the
Freedom of Information Act under section 40 (1):

 

40 Personal information.

E+W+S+N.I.

This section has no associated Explanatory Notes

(1)Any information to which a request for information relates is exempt
information if it constitutes personal data of which the applicant is the
data subject.

(2)Any information to which a request for information relates is also
exempt information if—

(a)it constitutes personal data which do not fall within subsection (1),
and

(b)either the first or the second condition below is satisfied.

(3)The first condition is—

(a)in a case where the information falls within any of paragraphs (a) to
(d) of the definition of “data” in section 1(1) of the Data Protection Act
1998, that the disclosure

 of the information to a member of the public otherwise than under this
Act would contravene—

(i)any of the data protection principles, or

(ii)section 10 of that Act (right to prevent processing likely to cause
damage or distress), and

(b)in any other case, that the disclosure of the information to a member

Following advice from the Information Commissioner that we have not been
sufficiently clear in our response to a portion of your original FOI
Request (ref: 840/12), I am writing to offer clarification of the matter.

 

In making your appeal you asked whether the selected candidate for the
post of Allotments Officer met selection criteria listed as essential on
the position description.  I shall address these criteria in order:

 

Experience

Required: Substantive 3 years work experience in grounds maintenance,
horticulture and/or landscape gardening

 

The selected candidate had a previous work history including more than
three years full time work as well as a number of contract positions.  
This experience included landscape construction and grounds maintenance.

 

 

Qualifications

Required: A recognised qualification in horticulture or related subject
(Degree, diploma, City and Guides, NVQ – includes RHS)

 

The incumbent to the post holds a University Degree in Landscape and
Garden Design.

 

 

Other requirements

Required: A full driving licence

 

The incumbent holds a full driving licence.
