Alleged speeding offence

Essex Police, Fire and Crime Commissioner did not have the information requested.

Dear Essex Police, Fire and Crime Commissioner,

I received a notice of intention to prosecute (NIP) for allegedly driving at 72mph in a temporary 50mph zone. The vehicle I was driving was fitted with a GPS tracking device that records time, date, speed and direction. This information can be replayed by logging into the tracker system. After being accused of the speeding offence I checked the GPS tracker records. It showed my actual speed was 53.1 mph at the time I was accused of driving at 72mph.

As I have entered a plea of not guilty will the magistrate court take into account the GPS tracker information that I have copied onto a word document. This record shows the location on a map with a street view of where the record was made etc.

The evidence I have would prove that I never exceeded more than 54.1 mph within the restricted speed limit area.

Would I be able to have evidence of the speeding offence from Essex Police i.e. from the TRUCAM device.

Would the fact that 2 police officers statements and TRUCAM evidence outweigh my evidence.

Could I contact the CPS and see what evidence they have from Essex Police and if they have been given any evidence that I provided Essex Police with my previous reply to the NIP i.e. the paperwork evidence that proves the speed, time, location and direction of the vehicle at the time of the alleged offence.

I contacted the Chief Constable and Assistant Chief Constable and they just stated that there was nothing they could do and there was evidence to proceed with the prosecution.

If I am successful in proving I did not commit the offence have I the right to take legal action for stress and anxiety this situation has caused me.
