Allegations against OSCR of targeting informants to the Scottish Child Abuse Inquiry.

The Office of the Scottish Charity Regulator did not have the information requested.

Dear The Office of the Scottish Charity Regulator,

I request the following under the 2002 freedom of information (Scotland) act.

A) All information that details allegations made by the public that they had been targeted by OSCR for informing the Scottish Child Sex Abuse Inquiry of any “notable event” within a charity regarding the safety of children in order to protect that charities reputation or funds.

B) All information detailing complaints that OSCR had resourced or encouraged charities to resource police, mental health services or other civil services in order to target complainants alleging “notable events” within charities such as child sexual abuse, anti-catholic abuse or racist abuse amongst others.

C) All information detailing allegations that OSCR had encouraged or otherwise recommended to charities that they downplay or ignore allegations made by others that spoke of sexual abuse of minors, discriminatory abuse of other or any other form of charity misconduct in order to have such events not classed as “notable” in the first place as to protect that charities reputation or funds.

I refer to your message of 16 May 2019, in which you requested information
under the Freedom of Information (Scotland) Act 2002. (FOISA)

Your request

The following extract from your request details the specific information
you are seeking:

A) All information that details allegations made by the public that they

Our response

In accordance with Section 17 of FOISA, I give you notice that this
information is not held by us.

The Charities and Trustee Investment (Scotland) Act 2005 (the 2005 Act)
places a duty on OSCR to encourage and assist charities in meeting the
requirements of charity law. Details of the activities we undertake,
together with our values can be accessed via the OSCR [1]website.

Your request relates to behaviours by OSCR which are quite the opposite to
how we carry out our work as Charity Registrar and Regulator, and I would
refer you to our [2]Unacceptable Actions Policy, and specifically section
3.1 which details the those behaviours and actions which we consider are
not acceptable.

Right of Review

You have the right to ask us to review our decision in respect of release
of information under FOISA.  Your request for review should be made within
40 working days of receipt of this letter and we will reply within 20
working days of receipt of that request.  If you still remain dissatisfied
you have the right to appeal to the Office of the Scottish Information
Commissioner.

To be rigiouris I would request a review to verify that by peer review and if OSCR may, can it offer an exsplanation as to the following:

Why a response has arrived on 14/6/2019 when the logical response should be a response given if given when given by OSCR on 15/6/2019 or 16/6/2019 ? Can the date be altered manually at OSCRs end ?

I refer to your email of 15 June 2019 (06:41) in respect of your request
under FOISA of 16 May 2019. In that message you request a Review on the
basis that ‘no response has been received’.

For clarity, I can confirm that a full response to this request was issued
by OSCR on 14 June 2019; and that in accordance with the original FOI
request, it was addressed to

I refer also to your email of 16 June 2019 (14:23) in which, having by
then received OSCR’s response, you request that a review is undertaken.
The basis for your review request, as stated in your message is ‘to be
rigioris’.

In accordance with Section 21(8)(a) of FOISA I am treating your request as
Vexatious, and can confirm that no review will be conducted.

This is because as I advised in my response of 14 June 2019, your request
related to correspondence in respect of behaviours and actions by OSCR
which are quite the opposite of how we carry out our work as charity
Regulator and Registrar; and also requests information which does not
exist.

Consequently my response under Section 17 of FOISA, that the information
you sought was not held, is valid.

YOUR RIGHT OF APPEAL 
You have a right under the Act to appeal my decision. You must appeal to
the Scottish Information Commissioner within six months following the date
of receipt of this review notice stating the reason for you seeking a

Dear The Office of the Scottish Charity Regulator,

The conclusion reached maybe valid but that’s not the issue hear...

So when asked to carry out peer reveiw to ensure neutrality in this matter OSCR has deemed it vexatious. That, along with its failure to require charities to inform it of notable events is OSCRs failing not mine and certainly not the he public’s - I shall mark this up as information not held.

This FOISR is rather peculiar one can see that I did send a reveiw request on 15th June 2019 however the response to that reveiw sent by OSCR states they sent there response on the 14th June 2019 is there anyway this could be done by the site itself or manually by a volunteer or by the respondent. If so, has this been done ?
