Dear Scarborough Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Scarborough Borough Council's handling of my FOI request 'All tree surveys conducted on all Council trees between Ashburn Road and Weaponness Valley Road.'.

On the 28th of May I sent a request for the above information. I was displeased with Scarborough Borough Council's reply for the following reasons:

1. I should have, by law, received a reply by 27/06/2011 and it was received on 30/06/2011.

2. The reply was in the form of a letter. I did not give my address nor my consent to be contacted in this way with regards to this issue.

3. The letter was sent to the wrong address.

4. My name was misspelled.

5. The council made the assumption that my Freedom of Information request is in relation to my "Public Liability Claim".

6. Because of No 5, I was told I would be contacted by the Council's Insurer. I do not wish for this. I simply want the information that I am entitled to and that the Council should provide.

7. The Council's Insurer has not contacted me to this day regardless, and it has been thirteen days since the letter was sent.

Re: FOIA1580 - Request for Review

Thank you for your email requesting a review of the Council's response to your request for information made under the Freedom of Information Act 2000 (FOIA).

You requested the following information:

"1. All tree surveys conducted on all Scarborough Borough Council trees between Weaponness Valley Road and Ashburn Road.

2. All complaints or concerns recorded by the Council in relation to these Council trees."

Having spoken to the relevant officers of the Council, I am informed that no tree surveys or reports are held in relation to the trees between Weaponness Valley Road and Ashburn Road, Scarborough.

I am however advised that individual trees are inspected in response to an enquiry or complaint being received, as with all trees around the borough within SBC ownership or responsibility. The extent of the records the Council hold concerning such enquiries and complaints are contained within the works orders raised if remedial pruning operations or removals are deemed necessary following inspection.

I therefore attach a copy of all recorded works orders relating to the area in question.

If you are not content with the outcome of this review, you may now apply directly to the Information Commissioner for a decision.
