Dear Leeds City Council,

In connection with the Hough Top Court Planning Application: 23/06663/FU, various publicly visible documents mention a pre-application consultation which took place January to March 2023 under Enquiry Number: PREAPP/22/00457.

The specific advice given by Highways, Planning and other Departments involved at that stage is not included within the current planning documents - yet is referred to several times.

As the applicant is Leeds City Council's own Council House Growth Team, we believe such advice should also be made publically available.

Therefore, under the Freedom of Information Act, I request the following information:

All Pre Application documents and responses in respect of PREAPP/22/00457, concerning Planning Application 23/06663/FU - "Erection of 82 affordable dwellings and associated open space and infrastructure to former Hough Top Court site."

I would like you to provide this information in an electronic format, such as .pdf or access via a portal or internet link.

I refer to your request to the council received on 08/04/2024 for the
following:

In connection with the Hough Top Court Planning Application: 23/06663/FU,
various publicly visible documents mention a pre-application consultation
which took place January to March 2023 under Enquiry Number:
PREAPP/22/00457. The specific advice given by Highways, Planning and other
Departments involved at that stage is not included within the current
planning documents - yet is referred to several times. As the applicant is
Leeds City Council's own Council House Growth Team, we believe such advice
should also be made publically available. Therefore, under the Freedom of
Information Act, I request the following information: All Pre Application
documents and responses in respect of PREAPP/22/00457, concerning Planning

We will respond to your request in accordance with the Environmental
Information Regulations 2004, within 20 working days, from the day after
your request was received. We will therefore aim to respond to your
request by 06/05/2024.

When responding to Environmental Information Regulations Request, EIR
states that a public authority shall apply a presumption in favour of
disclosure. However, regulation 12(3) states: “To the extent that the
information requested includes personal data of which the applicant is not
the data subject, the personal data shall not be disclosed otherwise than
in accordance with regulation 13 (personal information).”

With specific regard to the personal information held within the document
the Council considers that this should be excepted from release under
Regulation 12(3) & 13 of the Environmental Information Regulations, on the
basis that it constitutes the personal information of a third party, and
disclosure to a member of the public would contravene the first data
protection principle (namely that personal data must be processed fairly
and law-fully and transparently and shall not be processed unless at least
one of the fair processing conditions is met). Therefore, the information
has been redacted.

I trust that this response is satisfactory. Under Regulation 11, however,
you are entitled to make representations to us if it appears that we have
failed to comply with a requirement of the Regulations in relation to your
request. Representations must be made to us no later than 40 working days
after the date you believe we failed to comply with such a requirement. 

We will then consider your representations and supporting evidence and
decide if we have complied, notifying you of our decision as soon as
possible, and no later than 40 working days after the date of receipt of
your representations. 

Under Regulation 18, you are then entitled to apply to the Information
Commissioner for a decision as to whether, in any specified respect, your
request has not been dealt with in accordance with parts 2 and 3 of the
Regulations.

Can I suggest that in future such important detail about a planning aplication be added to the public portal? Much of the info you have redacted from the result you sent me is already visible on there in other documents.
