All Prosecutions for Perverting the course of justice and similar crimes

The request was partially successful.

Dear Crown Office and Procurator Fiscal (Scotland),

Under FOISA please provide me with information contained in your records as follows:

Please can you provide me with the following information for the time period 11/08/2018 until present date for Scotland. If the offence has a different name to those used in England and Wales, please provide details for the equivalent classification.

1. The number of all prosecutions for each of the following crimes:

a. Wasting Police Time by a civilian *
b. Perverting the Course of Justice by a civilian
c. Perjury by a civilian

* Knowingly making unsubstantiated, false, erroneous and libellous reports of crime against a person.

Please provide the same information for any of the above crimes COPFS have prosecuted a member of any and all ranks of The Police Service of Scotland officer’s in the same period as above.

Please break these figures down year on year and month on month.

This request should not invoke an erroneous cost exemption to be applied due to your new digital strategy for recording, processing, retaining, weeding and sharing data that is your responsibility to provide the Scottish Government with for official statistics.

If a referral to request this information is given to request this information from the Scottish Government is made then you would be implying that they are accountable for all prosecution decisions made by COPFS which would shine a light on the true accountability of the Scottish Government in all prosecutions.

I’ll look forward to your response within the standard 20 working day timescale.

Yours faithfully,

Ms S J Kerr
