Freedom of Information (Scotland) Act (FOISA), and received on 11 October
2016.

 

We would like to ask you to clarify your request so that we can identify
and locate the information which you have requested. Under Section 1(3) of
the FOISA, we do not have to supply you with the requested information
until you have provided us with more detail in this respect.

 

Please provide all notes, minutes, agendas and details/dates of meetings
with Aberdeen Football Club and/or their representatives since August 2016
to date.

 

This should include details of all group consultation meetings or meetings
at which Aberdeen City Council had a representative present including all
meetings related to the proposed development of a football stadium and
training ground at Kingsford near Westhill.

 

We would be extremely grateful if you could confirm that you are
interested in any and all meetings with AFC and/or their representatives
since August 2016, not just those relating to the proposed development of
a football stadium and training ground at Kingsford near Westhill?

 

If this is the case, we have concerns that the scope of your request is
too broad and it is likely to exceed the statutory cost limit (£600) to
respond to your information request, breaching Section 12 – Excessive Cost
of Compliance – of the FOISA.

 

To ensure your request is not refused on the grounds outlined above we
would ask you to consider whether you could narrow the scope of your
request by specifying areas of interest or relevant service areas (for
example Roads teams, planning, events etc.)

 

Clarifying these points will help us to be sure we are providing, where
possible, the information you are interested in.  Please note we will keep

Thank you for your request for review of 10 November 2016 on the basis
that you had yet to receive a response. Please accept our sincerest
apologies that Aberdeen City Council (ACC) failed to respond to your
information request of 12 October 2016, made under the Environmental
Information (Scotland) Regulations 2004 (EIRs).

 

In accordance with Regulation 16(5) of EIRs, please find below the
response to your information request, which comprises the Review Outcome:

 

Please provide all notes, minutes, agendas and details/dates of meetings
with Aberdeen Football Club and/or their representatives since August 2016
to date.

 

This should include details of all group consultation meetings or meetings
at which Aberdeen City Council had a representative present including all
meetings related to the proposed development of a football stadium and
training ground at Kingsford near Westhill.

 

Please include all notes and other material from these meetings.

 

I am interested in all meetings between ACC officials and councillors with
a focus on the Kingsford Stadium development and all related discussions
(including any workgroups re traffic of similar related planning issues)
with Aberdeen Football Club in the period since 1st August 2016 and the
date of my enquiry.

Please see attached notes of various discussions with ACC representatives,
AFC representatives and Aberdeenshire Council representatives.

 

Also, Gale Beattie, Acting Head of Service, Planning and Sustainable
Development, and Angela Scott, Chief Executive, had a meeting on Monday 5
September with AFC.  No agenda was set and no minutes were taken.  The
meeting discussed the timescale for submission of the planning
application.

 

Third party names and personal details, as well as the names of ACC
Officers who are below Head of Service level have been redacted (blacked
out) from the attached correspondence. This is because ACC considers that
this information is exempted from disclosure.

 

In order to comply with its obligations under the terms of Regulation 13
of the EIRs, ACC hereby give notice that we are refusing your request
under the terms of Regulation 11(2) in conjunction with Regulation
11(3)(a)(i) – Personal Information – of the EIRs.

 

In making this decision ACC considered the following points:

 

ACC is of the opinion that Regulation 11(2) applies to the information
specified above as the information in question is personal information
relating to living individuals, and the applicant is not the data subject.

 

ACC is of the opinion that Regulation 11(3)(a)(i) applies, as ACC
considers that disclosure of this information would be a breach of the
first Data Protection Principle (that personal information must be
processed fairly and lawfully). Third parties named within the attached
document and ACC Officers below Head of Service level would not expect ACC
to release this information about them into the public domain under the
EIRs (or the Freedom of Information (Scotland) Act 2002).

An application to OSIC must be made in writing within six months of
receipt of ACC’s Review Decision Notice.  When applying to OSIC for a
decision you should give your name and address for correspondence.  Please
note that OSIC will not be able to investigate if you have not used your
real name to make your information request. You must also specify:

 

● which request for information your requirement for review relates to

● the reason that you asked ACC to carry out a review of your request

● the reason why you are not satisfied with ACC's review outcome decision

 

The Commissioner will contact ACC and invite its comments on your
application.  Thereafter (if no settlement has meantime been reached), the
Commissioner must reach a decision within 4 months of receiving your
application, or within such other period as is reasonable.  You will
receive written notice of the outcome of the Commissioner’s decision.

 

Should you wish to appeal against the Scottish Information Commissioner's
decision, there is an appeal to the Court of Session on a point of law
