Alcohol at motorway service areas

Dear Department for Transport,

My understanding was that the current policy on the sale of alcohol at motorway service areas is paragraph 116 of DfT Circular 01/2008 (Policy on Service Areas and Other Roadside Facilities on Motorways), ie "There is to be no sale or consumption of alcohol anywhere on the premises of a MSA or MRA."

So I was surprised, when I stopped at Leicester Forest East northbound services on the M1, to find WH Smith selling alcoholic beverages from behind its counter (with a sign on the drinks fridge in the main area of the shop alerting customers to this service).

Please can you provide me under FOIA with a copy of the current policy on the sale of alcohol at motorway service areas, since it must have changed from Circular 01/2008.
