Dear Aberdeen City Council,

Alan Donnelly has been a councillor for many years, yet you only have one incorrectly-dated form for him for February 2020 (https://committees.aberdeencity.gov.uk/m... signed allegedly in 2017), and in the archives another incorrectly dated form for him (possibly for 2011 which is date on first page; events listed are 2009, and the typed date for the signature is 2007 - https://committees.aberdeencity.gov.uk/d... )

1. Please now either supply the missing registers of interest, which of course are supposed to be completed and scanned yearly, or advise if none were submitted.

2. Please advise on what date the current one, dated February 2020, was submitted to the council to be uploaded, and when it actually was uploaded.

These are meant to be accurate and signed off and dated. Arising from this FOI request, can someone kindly make sure records are accurate? It would be useful to the electorate.

I will consider it an unnecessary stalling tactic if you revert to say i could do this via the ACC website; I am already on record several times as saying I will not do so.

Thank you for your information request. We have completed the necessary
search for the information requested and please accept our apologies for
delay in providing the response to you. Our response is now detailed
below.

Alan Donnelly has been a councillor for many years, yet you only have one

 1.  Please now either supply the missing registers of interest, which of
course are supposed to be completed and scanned yearly, or advise if none
were submitted.

The ROI that is online is correct for the current term of office. One
register is uploaded for a term per elected member, rather than per year.
It is updated as the member requests a change/and or submits a
gift/hospitality received and uploaded straight away to reflect this onto
the public site. The date at the top reflects the last date in which the
register was updated (in Cllr Donnelly’s case it’s Feb 2020). The bottom
date is signed shortly after election of the current term (2017) and is
also when the ROI in question is initially uploaded to the site.

2.  Please advise on what date the current one, dated February 2020, was
submitted to the council to be uploaded, and when it actually was
uploaded.

 These are meant to be accurate and signed off and dated.  Arising from
this FOI request, can someone kindly make sure records are accurate?  It
would be useful to the electorate.

The request to update it was made on 05/02/2020. We don’t know the exact
date it was uploaded but it should usually be within a couple of days
after the request.

We are unable to provide you with information on when it actually was
uploaded.  In order to comply with our obligations under the terms of
Section 17 of the FOISA, we hereby give notice that this information is
not held by us.

The previous registers are not missing, as Aberdeen City Council aren’t
obliged to have them online at all. Regulation 7 of  The Ethical Standards
in Public Life etc. (Scotland) Act 2000 (Register of Interests)
Regulations 2003 require that they be open to public inspection at the
offices, which they are. We choose to put the current term online, but
this isn’t legally necessary.

We handled your request for information in accordance with the provisions
of the Freedom of Information (Scotland) Act 2002.
