Thank you for your recent request for information which I have enclosed
below for ease of reference.  Your request has been treated in accordance
with the Freedom of Information Act 2000 and/or the Environmental
Information Regulations 2004.

I can confirm that we do hold information that falls within the scope of
your request. The answers to your questions have been provided in red text
below.

Q. How many buildings do you occupy which have air conditioning. Provide
addresses

We have 33 buildings which have Air Conditioning units in them. The
majority of these will be small units and are designed to keep servers/ IT
equipment at the correct temperature.

The breakdown is:

Q. Who is the responsible person for ensuring that your buildings are
legally compliant on the TM44 requirement? Provide the name, position,
address, email address and direct telephone number of the responsible
person.

Newport City Council is the legal entity that is the overall duty holder.

Q. All reports are mandatorily lodged on the MHCLG database. No reports
are currently lodged or are out of date, you are therefore non-compliant.
When do you intend to rectify the situation?    

All TM44 reports for Newport City Council are not due until 2023. The
certificates are uploaded on the following databases; CIBSE Certification
Limited – CIBSE Database, and a copy of the certificate is lodged on the
national register under the energy performance of buildings regulations
2012. It is available on www.ndepcregister.com

Q. Air conditioning and air handling systems can cause increased risk of
Covid-19 spread, have you included the TM44 into your return to work risk
assessments?

TM44 are not specifically included however risks associated with air
conditioning systems are part of our risk assessments where relevant

Q. If you use a Facilities Management Company to manage compliance, who
are they?

Newport City Council employ Newport Norse Limited to undertake some
elements of compliance. The remaining requirements are undertaken by the
local authority directly.
