Please provide details of the guidance used by your planning department to:

a) determine if land is agricultural;
b) if there is an established agricultural unit operating on the land;

The Council has identified that it is able to determine this without reference to DEFRA.

Dear Mr Carruthers

Thank you for your request of information that is being considered. You may be aware that we have 20 working days in which to respond to Freedom Of Information (FOI) requests and you will therefore hear from me again by 6 May 2015 or earlier if possible.

For your information, the Act defines a number of exemptions, which may prevent release of the information you have requested. If any of the information you have requested is not contained in a recorded format, South Norfolk Council is not obliged to create information for the purpose of responding to your request

There may be a fee payable for ‘reasonable disbursement’ costs such as postage and photocopying. This will be considered and you will be informed if a fee is payable. In this event the fee must be paid before the information is processed and released. The 20 working day time limit for responses is suspended until receipt of the payment.

Dear Mr Carruthers

I refer to your Freedom of Information request to which I am now in a position to respond.

The Council determines if land is agricultural and if there is an established agricultural unit operating on the land in line with national planning legislation, including Section 336 of the 1990 Town and Planning Act and The Town and Country Planning (General Permitted Development) (England) Order 2015. All legislation can be accessed via the internet. Each case will be determined on its own merits, taking relevant information into account.

I hope this is of assistance and is sufficient to meet your requirements, but if, for whatever reason you wish to get back to me, please feel free to do so. In particular if you are unhappy with the information provided or how your request was handled please let me know and I will explain how you can request an internal review of our decision.

Dear Right2Know,

The definitions in the Town and Country Planning Act are derived from the Agriculture Act 1947. The UK is no longer responsible for Agricultural policy - and policy set in Europe is administered by DEFRA. This is not the same as DCLG. Agriculture is regulated by DEFRA not the Town and Country Planning Act 1990.

Could you confirm if a holding of about 70 acres (registered with DEFRA) would have been considered to be an agricultural holding by the Council in the 1990s or would the Council have required planning consent to be sought and have rejected prior notification applications. Obviously the Council must have published guidance as it acted in this way.
