We have completed the compilation of information in response to your
request.

 

We can confirm that we do hold some information of the description
specified in your request and this information, where it is not exempt is
provided attached with a further explanation below.

 

Your request

 

Agreements with the Office of Chinese Language Council International
(Hanban) and the Beijing University on the establishment / continuation of
the Confucius Institute at UCL Institute of Education.

 

Our response

 

Please see attached for the agreement between Confucius Institute
Headquarters of China and the UCL Institute of Education (IOE) on the
establishment of the Confucius Institute dated 8^th June 2012. Please also
see attached for a copy of the related extension letter dated 9^th January
2017.

 

Please note that in relation to the information requested for agreements
with Beijing University, if any information is held, this would be held in
hard copy. Due to the Covid-19 pandemic, the majority of our buildings are
currently closed and we are therefore unable to check whether we hold this
information until we are back in the office.

 

Some of the requested information has been withheld under section 40(2) of
the FOIA by virtue of s40 (3)(a)(i).

 

Section 40(2) of the FOIA allows a public authority to withhold
information under the FOIA where (i) the requested information is personal
data relating to someone other than the requester and (ii) its disclosure
would breach any of the data protection principles.

 

This exemption applies to the requested information relating to the names,
job titles and contact details of staff members and third parties. In this
case we believe that the requested information relates to and identifies
individuals and would be considered as their personal data. The disclosure
of this personal data would not be within the reasonable expectations of
the individuals concerned and it would be unfair to do so; this therefore
breaches the first data protection principle.

 

It is for these reasons that this information is exempt under section
40(2) of the Act.

 

As the section 40(2) exemption is an absolute one, there is no need to
conduct a public interest test.

 

You are free to use any information supplied for your own use, including
for non-commercial research purposes. The information may also be used for
the purposes of news reporting. However, any other type of re-use, for
example by publishing or issuing copies to the public, will require the
permission of the copyright owner.

Dear University College London,

I am writing to request an internal review of University College London's handling of my FOI request 'Agreements on the Confucius Institute' dated 28th January 2020.

I have reasonable grounds to suspect that not all agreements and supplementary agreements have been made available to me.

In response to my FOI request, I received a copy of the agreement between the UCL Institute of Education and the Confucius Institute Headquarters of China. In Article 3 of this agreement, a "supplementary agreement" is mentioned. The University College London didn't provide this supplementary agreement, even though I mentioned this explicitly in my request.

I request an internal review. I want all(!) agreements that fall within the scope of my FOI request to be made available to me.
