Dear Mr Wallis

Thank you for your emails dated11th November 2017, in which you ask for
the following

Please will you provide me with the following:

Commissioner, Kevin Hyland, in November 2014 to present date.

Please, will you provide me with the following:

(a) All communications between Sandra Horley CBE and the Office of the
Independent Anti-slavery Commissioner, Kevin Hyland.

(b) Agendas and minutes of any meetings between Sandra Horley and the
Office of the Independent Anti-slavery Commissioner, Kevin Hyland.

Please, will you provide me with the following:

(a) All communications between the Bishop of Derby, The Rt. Rev. Dr.
Alastair Redfern and the Office of the Independent Anti-slavery
Commissioner, Kevin Hyland.

(b) Agendas and minutes of any meetings between Bishop of Derby and the
Office of the Independent Anti-slavery Commissioner, Kevin Hyland.

From the date of the appointment of the Independent Anti-slavery
Commissioner, Kevin Hyland, in November 2014 to present date.”

I am writing further to my emails of 16^th November 2017, about your
requests shown above.  Your requests have been handled as requests for
information under the Freedom of Information Act 2000 (FOIA).

Under section 12 of the Act, the IASC is not obliged to comply with an
information request where to do so would exceed the cost limit.

We hold information you have requested and have estimated that the cost of
meeting your request would exceed the cost limit of £600 specified in the
Freedom of Information and Data Protection (Appropriate Limit and Fees)
Regulations 2004.  We are therefore unable to comply with it. The cost
limit would be exceeded recovering this amount of information.

The £600 limit is based on work being carried out at a rate of £25 per
hour, which equates to 24 hours of work per request. The cost of locating,
retrieving and extracting information can be included in the costs for
these purposes.  The costs do not include considering whether any
information is exempt from disclosure, overheads such as heating or
lighting, or items such as photocopying or postage.

If you refine your request, so that it is more likely to fall under the
cost limit, we will consider it again. These requests were received on the
same day and we have considered them as one request.

Please note that if you simply break your request down into a series of
similar smaller requests, we might still decline to answer it if the total
cost exceeds £600.

Even if a revised request were to fall within the cost limit, it is
possible that other exemptions in the Act might apply.

If you are dissatisfied with this response you may request an independent
internal review of our handling of your request by submitting a complaint
within two months to [email address], quoting
reference wallis11.11.17. If you ask for an internal review, it would be
helpful if you could say why you are dissatisfied with the response.

As part of any internal review the Department's handling of your
information request would be reassessed by staff who were not involved in
providing you with this response. If you were to remain dissatisfied after
an internal review, you would have a right of complaint to the Information
Commissioner as established by section 50 of the FOIA.

Yours sincerely

Further to your email and request for more specificity and narrower parameters please can you provide details that relate or mention any of the following: myself, Unseen, the Modern Slavery Helpline. I believe these parameters will enable you to come under the £600 threshold.

Please also note that this request is to be treated separately and not amalgamated as you have suggested in relation to my other FOI's.

Yours sincerely,

Dear Independent Anti-Slavery Commissioner,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Independent Anti-Slavery Commissioner's handling of my FOI request 'Agenda and Minutes of the IASC Advisory Panel and correspondence.'.

I acknowledge receipt of the minutes and agenda of the IASC Advisory Panel. Yet, in regards to the request under the FOI for copies of communication that relates to myself, Unseen or the Modern Slavery Helpline as I have twice pointed out, under the FOI legislation this request must be treated as a separate FOI request but on two occasions now the IASC office has said they are treating this as part of a suite of requests for information. This is factually incorrect and we believe the request stands on its own and therefore would fit within the parameters of both cost and more importantly the need for transparency around the commission's office and his communications.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/a...

Yours faithfully,

Andrew Wallis

Dear IASC,

According to the law, you should have responded promptly to my request for an internal review. As this has not been forthcoming and there is no reason as to why you continue to obstruct my request for the information via FOI legislation I have no option than to make a complaint to the ICO and ask them to investigate your office.

Yours sincerely,

Subject: Re FOIA request Advisory Panel

Dear Mr Wallis

Thank you for your email of 10^th January 2018, in which you requested a
review of the handling of your Freedom of Information request:

“All correspondence between the advisory panel and the office of IASC and
Kevin Hyland”.

And

“Details that relate or mention any of the following; myself, Unseen, the
Modern Slavery Helpline”

I have undertaken a review of the response to this request. I note that
part of your request in relation to the minutes and agendas of all
meetings of the advisory panel was released to you. I am in agreement with
the original response that alongside the other requests you have submitted
seeking correspondence etc between a number of people it is still not
possible to provide the information which you have requested at a cost
below the £450 limit. In addition even if this request was treated
individually it would still exceed the cost limit.

Under section 12 of the Act, IASC is not obliged to comply with an
information request where to do so would exceed the cost limit.

We have estimated that the cost of meeting your request would exceed the
cost limit of £450 specified in the Freedom of Information and Data
Protection (Appropriate Limit and Fees) Regulations 2004.  We are
therefore unable to comply with it due to the amount of work required.

Even if you refine your requests further, it is unlikely to fall under the
cost limit. Please note that if you simply break your request down into a
series of similar smaller requests, we might still decline to answer it if
the total cost exceeds £450.

Even if a revised request were to fall within the cost limit, it is
possible that other exemptions in the Act might apply.

Please be advised if you resubmit this or a similar request you may not
receive a response from us.

If you remain dissatisfied you have a right of complaint to the
Information Commissioner as established by section 50 of the Freedom of
Information Act.

Yours sincerely
