Please see attached.
We have not been able to provide the figures by calendar year because we
do not hold it in that format. We are not able to manipulate the figures
into calendar year format because we do not have enough information in the
data that we do hold to be able to do this. The full data is held by
schools themselves which, for the purposes of the Freedom of Information
Act, are individual public authorities in their own right. If you would

The attached figures do not include temporary staff because we do not have
the facility to identify them in our accounting system. It would be
theoretically possible to manually check, but to do so would involve
looking at many thousands of records. We have estimated that this process
would by far exceed the appropriate cost limit for FOIA requests. Section
12 FOIA 2000 provides that a public authority is not obliged to comply
with a request for information if it estimates that meeting the request
would exceed the appropriate cost limit. This ‘appropriate limit’ is set
out in the Freedom of Information and Data Protection (Appropriate Limit
and Fees) Regulations 2004. The ‘appropriate limit’ for non Central
Government public authorities is currently set at £450. In relation to
staff time, this is calculated at a rate of £25 per member of staff per
hour. This effectively equates to a time limit of 18 staff hours.
Where a public authority estimates that responding to the request would
exceed the appropriate limit, there is no obligation on the public
authority to carry out searches up to the 18 hour limit. Section 12
effectively removes the information from the scope of the duty to disclose
altogether. It is for this reason that we have not sought the figures
relating to temporary staff. Under the terms of the FOIA 2000 you are
entitled to refine the information that you are seeking. The County
Council would then reconsider the request to determine whether it could
provide the information within the appropriate limit. But again, you may
wish to contact individual schools for this information.
Please also note that Agency staff could be teaching or support/admin
staff as there is no distinction in our accounting system.
We do not hold the information for Academies.
